Such agencies will be provided the <br />opportunity to submit their reasons, and their ability to meet <br />the criteria for such participation to the Coordination Committee <br />for approval. Other federal entities may be required by the <br />Service to participate in this Implementation Program as a result <br />of consultation under section 7(a) (2) of the Endangered Species <br />Act. The specific criteria for such participation are listed in <br />Section 5 of this Implementation Program. <br /> <br />Although not formal, voting participants in this Implementation <br />Program, any member of the public may attend the open meetings of <br />the Committees and present his or her concerns or recommendations <br />for consideration by Implementation Program Participants. <br /> <br />In order to carry out this Implementation Program, three <br />committees will be established: a Coordination Committee, a <br />Biology Committee, and a Navajo Dam Operating Committee. The <br />composition arid functions of each committee are discussed in <br />Section 5.0. <br /> <br />Participation in this Implementation Program is voluntary. Each <br />Participant will assess whether Implementation Program goals are <br />being achieved. If any Participant decides not to continue, that <br />Participant will submit its reason(s) to the Coordination <br />Committee in writing. The Coordination Committee will be given <br />sufficient time to resolve any problem(s). If participation in <br />this Implementation Program is essential to implementing a <br />reasonable and prudent alternative to avoid jeopardy to the <br />endangered fish species, a Participant's withdrawal may result in <br />reinitiation of consultation under section 7 of the Endangered <br />Species Act. <br /> <br />1.6 TRUST RESPONSIBILITIES <br /> <br />The reservations of four federally recognized Indian tribes are <br />located within the Basin. The four tribes have reserved water <br />rights under federal law, most of which have not been quantified, <br />to provide water to the reservations for use as permanent <br />homelands. The Secretary of the Interior has a trust <br />responsibility to assert and protect the trust water resources of <br />the tribes. <br /> <br />With regard to three of the four tribes, there currently are <br />specific federal plans for the partial development of tribal <br />water resources. Under the Act of June 13, 1962, 76 Stat. 96, <br />Congress authorized, among other things, the construction of NIIP <br />to benefit the Navajo Nation.
