<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I' <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />38 <br /> <br />(i.e., measures) to lessen impacts to endangered fish. <br /> <br />4.2.3 Monitoring of Accomplishment of Reasonable and Prudent <br />Alternatives <br /> <br />As discussed in Section 4.1, if a federal agency determines that <br />an action it authorizes, funds, or carries out "may affect" a <br />listed species or adversely modify or destroy critical habitat, <br />it is required to initiate formal section 7 consultation with the <br />Service. If the Service finds that the effect to the species is <br />of such significance as to be likely to jeopardize the continued <br />existence of the species, or result in destruction or adverse <br />modification of critical habitat, a "jeopardy" or "adverse <br />modification" biological opinion is issued at the conclusion of <br />the consultation. That opinion will include, if possible, <br />reasonable and prudent alternatives to the action which would be <br />designed to remove jeopardy or adverse modification. Following <br />the issuance and acceptance of a biological opinion containing <br />reasonable and prudent alternatives, the steps taken in <br />satisfaction of the requirements of such alternatives will be <br />monitored and incorporated into the review of progress in the <br />recovery of the species for future consultations. <br /> <br />4.3 TRUST RESPONSIBILITIES IN CONNECTION WITH SECTION 7 <br />CONSULTATIONS <br /> <br />Due to competition for limited water resources in the San Juan <br />River Basin, whenever a request is made for section 7 <br />consultation, the Department of the Interior will use its <br />authority to the fullest extent possible so that actions are not <br />taken by federal agencies requesting such consultation in <br />derogation of the water rights and related rights of the Tribes <br />signatory to the Cooperative Agreement. <br />
