In light of questions 3 above, is it not true that for the ALP proponents to secure a
new water supply from Navajo Reservoir, existing contracts to deliver water must be
voluntarily relinquished?

Please see the Discussion in Citizens' Question 2.B above. There are 8 short term water
service contracts for water from N avaj 0 Reservoir that total 21,380 acre-feet annually. All
but one of these contracts will expire on or before December 31,2005. In order for any of
this water to be available for other uses before expiration of the contract, the user would
have to volWltarily relinquish his rights under the contract. There is an "Agreement
Between the United States and the Navajo Tribe of Indians for Delivery of Water from
Navajo Reservoir" (Contract No. 14-06-W-269) providing an average annual diversion of
508,000 acre-feet from Navajo Reservoir. The contract is valid through April 10,2016 and
is subject to renewal at the option of the Navajo Nation for additional periods of 40 years.

** 1/7/97 - PREUMINARY - SUB,JECTTo REVISION - FOR DISCUSSION PURPOSES ONLY **
