<br />only; provided, however, that the height of the bottom of the splllway

<br />above the bottom of the stream channel shall not exceed 15 feet, and
<br />that the capacity of the reservoir or tank shall not exceed 10 acre-feet,
<br />and that" in the construction of such dam, the owner or builder shall
<br />follow general plans and specifications to be furnished by the S'tate Engineer.
<br />Also that, prior to construction, the,owner shall file with,the State Engineer
<br />an application for permiss ion to build the dam', together with plans and
<br />specifications and other pertinent data, in such detail ,as to enable the State
<br />Engineer to pas sproperly upon each dam. Forms are furnished by the
<br />State Engineer principally for sake of uniformity, both for data required
<br />and uniformity of 'size for filing.
<br />
<br />The law requires that:
<br />
<br />"The State Engineer's certificate of approval of a live-
<br />stock water tank on each normally dry stream and its tribu-
<br />taries,. shall be chronologically numbered in the order of the
<br />completion thereof, and priority of right as between such
<br />tanks, located on or within the watershed of each such dry
<br />stream, shall be determined by such numbers seriatim,
<br />,number one being first in,such right. The certificate of
<br />approval, specified in Section 8, shall contain a certifica-
<br />tion of the priority of the use specified herein. "

<br />Furthermore;
<br />
<br />"Where, in the judgment of the State Engineer, such
<br />tanks upon such stream and its tributaries, do not require
<br />conduits for purpos es of safety or the protection or prior
<br />stock water tank rights, it shall be lawful for the State
<br />Engineer to approve plans, drawings and specifications
<br />not calling for cond!lits; provided that nothing in this sec-
<br />tion contained shall be construed as abrogating the right
<br />of any owner of a vested water right or appropriation of
<br />wate,r to require such conduits in any case where neces,-
<br />sary in order to protect such senior right."
<br />
<br />Construction of large reservoirs requires the prior approval of
<br />the Colorado State Engineer (sec. 147-5-5).

<br />Idaho
<br />
<br />The State constitution provides that no law will be passed denying
<br />the right to divert and appropriate the unappropriated water of any natural
<br />stream to beneficial uses except that the State may relegate and limit the
<br />use thereof for power purposes.' Priority of appropriation determines the
<br />right among the various us ers.
