<br />. This table is a summary of application of the 20 coal unsuitability criteria from 43 CFR 3461 to the federal coal planning area. See
<br />Appendix 2, for more detailed information.

<br />I The unsuitability criteria are subject to exemptions and/or specific exceptions. General exemptiorui applicable to several criteria include:
<br />lands subject to valid existing rights (Criteria Numbers 1, 3, 4 [limited]); lands to which the operator has made substantial legal and
<br />financial commitments prior to January 4, 1917 (all except Criteria Numbers 3, 4, and 19); surface coal mining operations existing
<br />nn August 3, 1977 (all except criteria Numbers 4 and 7); and lands lor which a mining permit has been issued (an but 3, 4, and
<br />7). All criteria except 4, 5, 6, IS, 16, and 19 are also subject to one or more specific exceptions. For example, the exceptions to Criterion
<br />Number II state that a lease may be issued if stipulations can ensure that eagles are not disturbed during the breeding season, or if
<br />the Fish and Wildlife Service determined that the nest(s) of golden eagles can be moved; and the size of a buffer zone can be decreased
<br />if active eagle nests wiU not be adversely affected. Results did not change after the exemptions were considered because the criteria
<br />were nol applied to leased lands (43 CFR 3461.4-2), and none 01 the exemptions were applicable to the unleased lands in tbe coal
<br />planning area.
