basis of 60 acres or even less. It is estimated that lands to s. total of
1.052 acres within the projeet sJ:'ea will not adhere to the project plan.
Iilld in "!ihst .ease the total projeet area would b'e reduced to 12,500 acres
of land.

Additional 'lNatar Supply for Uppe:t;..Lands

In what follows it is attempted to evaluate the gains in water
supply to upper lands that will follow transfer upstream of water rights naw
owned and used belaw Fire Mountain Oenal. The analysis has not been search-
ing or exhaU5tive. but the resul t8 are believed conserv-ative~

The total wat'er supply available for diversiQn from Leroux Oreek
is composed Qf the following elementsl

a. Direc'~ flOfli of Leroux Oreek - Indetenninate, highly variable
during irrigation season. and
whOlly inadequate at present.
. b. Direct floT Overland Ditch - FlQW through reservoir after
:filling end from ereeks. 6~BS- .
e.dalong Overland Ditch.
c. 37 Leroux Oreek. Reservoirs - Decreed 4.096 ac. :ft., but the
ma1dm1:ll1l delivery is 2,879 ae. :ft.
d. Overland Reservoir - Capaeity 2.700 sc. :ft., in ad-
diti<Jln to water under "'b".

The :first 8 second-f'est of Leroux Oreel~ direet flow goes to upper lands
but praetically all the rest a:fter the f'1.ood peaks goes to lands below
Fire Mountain canal. These lands also 0ilIll abont2,OOO acre-feet of Le-
roux Oreek storage and 500 acre..:f'eet 01' Overland storage. Upper lands
seem to get 1'rom 2.500 to 3.000 aore-:f'eet :t:r<oo:n sources "b" and "dJl above
but apparently own very little Leroux Creak storage.

In 1938 the up.perlands diverted. from LeroUi~ Oreek (including
Overland ~ter) exactlY :3 aere-feet per aore for 4,910 acres. In 1939
the diversion was 1.4:3 acre-reet per aore. Some water is also obtained.
by these lands :from Aspen oreek and Current Creek and from seepage and
return 1'1_ rediverted near the lower end. of the area.

Since 1938w8s a year of better than average supply, 1lIhile 1939
was one of the dryest yea:rs, carnparison o:f the oter cOllllnissioner'.s re-
cords of dlveraion ror those years, insofar as it indieates any gy;s-
tElillatic values eommon to both years shOuld be of' value. In both years
Overland storage was called when direct diversion to upper lands dropped
to 50 seoond#feet, the resp.ective dates being June 19. 19:36, and May 16,
1939. In both yea:t"s also lower lands were at that time diverting about
150 seoond f'eet, or slightly more. with a few small reservoir releases
to snall junior rights in lower ditches. In nei~her year did direct
diversions to lower lands drop to 50 second-feet (the apparent require-
ment of upper lands) until about 30 days after the first call for Over-
land storage by lands above.

-3-
