.

.
Reclamation

that the Gallup-

We are advised by the Bureau of

Navajo Project is supported by the City of Gallup and the Navajo Tribe.

By letter dated March 30, 1976, the Interstate Staream Com-

mission recommended to the Secretary of the Interior that he reserve

26,000 acre-feet of the water to which the United States is ent~tled

under State law for such reasonable period of time as is necessary to

determine the feasibility of works to apply up to that amount of water

"to beneficial use on the Jicarilla Apache Reservation.

The Bureau of Reclamation, under a memorandum of agreement

with, the,~ureau of Indian Affairs, has completed a study of potential

uses on the reservation which indicates it is feasible to develop

-
only 3000 acre-feet of depleti~n annually on the reservation. It is

our understanding that the Bureau of Indian Affairs and the Tribe are

continuing to study water ?evelopment on the reservation. In their

recent submittals, the Bureau of Reclamation has tabulated the

Jicarilla depletion at 3000 acre-feet per annum and it may be assumed

that the Secretary is no longer reserving the balance pursuant to

the ISC recommendation.

The office has received the following requests for water

in addition to the depletions listed in Table 1:

Consolidation Coal Co. 15,000 AF annually
Arch Minerals 30,000 AF annually
Public Service Co. of N.M. 60,000 AF annually
Total 105,000 AF annually

Assuming that the depletions listed in Table I under the USBR column
will be realized, only 7000 acre-feet would be available within New

Mexico's determination of its share of Upper Basin water for these

"other" requests. The Commission could elect to support contracts

for the above requests in lieu of those Navajo Reservoir contracts

listed in Tables I and II.

- 7 -
