That shortage would impose a <br /> <br />50% shortage on New Mexico's Animas-La Plata Project water users. <br /> <br />Under the Animas-La Plata Project contracts currently <br /> <br />proposed by the Bureau, the municipal and industrial contractors <br /> <br />would have the first right to the available supply in times of <br /> <br />shortage. The Commission Secretary has objected to that provision <br /> <br />(see attached May 25, 1982 letter from Reynolds to Brown). A short- <br /> <br />age of 50% to New Mexico's Animas-La Plata Project users would leave <br /> <br />a nearl~full supply (89%) for the New Mexico municipalities served, <br />but nOne for the irrigators dependent on the project, which they <br /> <br />likely would fiDd intolerable. <br /> <br />The impact on New Mexico's Animas-La Plata Project water <br /> <br />users could be mitigated by including in any new or extended con- <br /> <br /> <br />tracts for the Navajo Reservoir supply a condition requiring that <br /> <br />those contractors share shortages induced by a deficiency in New <br /> <br />Mexico's compact entitlement with New Mexico's Animas-La Plata Pro- <br /> <br />ject water users. The 17,000 acre-foot shortage would then be shared <br /> <br />by Navajo Reservoir supply contracts totalling 78,000 acre-feet as <br /> <br />listed in Table II and the 34,000 acre-feet of depletion attributable <br /> <br />to the Animas-La Plata Project, resulting in a shortage of 15% to <br /> <br />those commitments. A shortage of 15% might be tolerable if the <br /> <br />Animas-La Plata Project irrigators are not required to absorb the <br /> <br />entire shortage (5100 acre-feet) assigned to that project; if the <br /> <br />project's municipal and industrial contractors have the first right, <br /> <br />the irrigator's shortage would amount to an intolerable 36% <br />5100 <br />(14000 x 100 = 36). <br />If the Secretary elected to contract the full amount of <br /> <br />100,000 acre-feet through 2030 and we have only 703,000 acre-:eet <br /> <br />- 12 - <br />
