<br />OG9'J <br /> <br />7.2 MOA's to Confirm Participation in Enlargement Project- Entities <br />that choose to participate in the project to enlarge Fry-Ark Project facilities will <br />be asked to commit to the implementation phase of ihe enlargement projects by <br />signing a Memorandum of Agreement (MOA) with the Enterprise. The MOA will <br />ask participants to commit to a share of the costs (proportionate to their share of <br />the proposed enlargement) to secure authority for the enlargement project, <br />referred to as the Implementation Phase of ihe PSOP. Such costs will include <br />legislative/lobbying work to secure authority for a federal-level feasibility study, <br />the feasibility study for Pueblo and Turquoise reservoirs, ihe NEP A compliance <br />process including any environmental impact statements, securing legislative <br />authority for the enlargement of Project facilities, and legal and staff-time costs <br />incurred by the Enterprise to facilitate the implementation of the enlargement <br />elements of the PSOP. These MOA's are to be executed no later than October I, <br />2001. <br /> <br />A separate agreement/contract will need to be executed to affIrm participation in <br />the actual construction project; ihat will include a commitment to pay for a <br />proportionate share of the construction costs. A draft agreement for commitment <br />to fmancial participation (allotment contracts) will be sent to all entities in the <br />District following congressional authorization for the enlargement project and <br />appropriate negotiations with Reclamation and NEPA compliance--following the <br />PSOP Implementation Phase, about 2006. <br /> <br />7.3 Financial Commitment to PSOP Implementation - Those entIties <br />participating in re-operations and enlargement shall bear their proportionate share <br />of implementation costs for each of the PSOP elements. The Enterprise will <br />monitor all costs and collect participant payments associated with PSOP <br />implementation. <br /> <br />The Enterprise shall track the costs for each option separately. For the first half of <br />year 2001 the Enterprise shall upfront fund all expenses as incurred. Then in July <br />nf 2001, invoices shall be sent to the appropriate participants to reimburse the <br />Enterprise and to pay for the estimated costs for the upcoming quarter. At the end <br />of each quarter, invoices shall be sent to each participant. Included with the <br />invoice will be a summary verifying the past quarters costs, giving credit for what <br />has been paid already and then adding on the next quarters estimate. Thus, each <br />participant will be paying as they go for their proportionate share of the costs. <br /> <br />A preliminary four-year budget for implementation has been developed (see page <br />19). This is the best estimate that the Enterprise has at this point, and will be <br />adjusted each year to reflect actual costs and better estimates as they are <br />determined. <br /> <br />18 <br />
