.

.

IV. STOCKING OF NONNATIVE SPECIES DIRECTLY INTO OCCUPIED ENDANGERED FISH
HABITAT.

There shall be no stocking of non-salmonid, nonnative species in
riverine habitat that is occupied by the endangered Colorado River
fishes.

V. REVIEW PROCEDURES

Figure 1 summarizes the process for reviewing stocking proposal
developed under Part II or Part III of the Procedures. The proponent of
a stocking proposal may elect to withdraw or modify a proposal at any
time in response to identified concerns. At such time a proposal is
approved or withdrawn, the States, Service, Recovery Program
Participants and other interested parties will be so notified.

Steo 1. Formal Stockina Prooosal. The review process is initiated with
a formal stocking proposal developed in accordance with the
guidelines outlined in Part II or III of the Procedures.
Proposals to stock nonnative fishes will be founded on sound
biological evaluations and contain sufficient information to
allow for an objective and complete evaluation.

Steo 2. Public and Aaencv Review. Stocking proposals will be submitted
to the Service, the States, participants in the Recovery
Program and other interested parties for review and comment for
a 60 day period. It is recognized that review by the Service
and the States will be based on sound biological principles
that shall be specifically identified. Furthermore, if the
Service or State agency objects to a stocking proposal, that
agency will make a concerted effort to identify reasonable
alternatives. As part of its review, the Service will assess
(a) the likelihood that the proposed stocking will result in a
"taking" under Section 9 of the Endangered Species Act (ESA)
and (b) the implications of the proposed stocking to the
viability of the Recovery Program to serve as a reasonable and
prudent alternative to water development projects that are
subject to Section 7 consultation.

Steo 3. Informal ESA Consultation. The proponent of the proposal will
within 30 days contact the Service to determine (a) if any
Federally listed or candidate species may be affected by the
stocking proposal, (b) if a review of the stocking proposal
pursuant to Section 7 of the ESA is required, and (c) other ESA
requirements, if any, that need to be addressed during the
review of the stocking proposal.

Steo 41Al Proposals Not Subject to Section 7, ESA Consultation.

Most proposals to stock nonnative fishes are initiated by State
or private parties and do not require Federal approval,

8
