All lands acquired and held for project con- <br />struction and operation and water surfaces of pro- <br />ject reservoirs will be open to the public for recrea- <br />tional purposes, excepting those areas reserved by <br />the operoting agency. <br /> <br />13. The project will be operated in such a man- <br />ner that those in eastern Colorado using proiect water <br />imported from the Colorado River Basin for domestic <br />purposes sholl have preference over those claiming <br />or using water for any other purpose. <br /> <br />14. The project is to be operated in such a man- <br />ner os to secure the greatest benefit frol11 the use <br />and reuse of imported project woters within project <br />boundories in the State of Colorado. <br /> <br />18. No tronsmountain diversion of water sholl <br />ever be mode through the collection and diversion <br />system of Ihe Fryingpan.Arkonsas project in excess of <br />the quantitative limitations and conditions established <br />by this document. PROVIDED, HOWEVER, ThaI when, <br />under the lows of the State of Colorado, there may be <br />oddiiicnal wa'er avt.liloble for such collection and di. <br />version which is not at the time of diversion required <br />for beneficial use in western Colorado or for filling <br />interstate water compact agreements, then such <br />water may be collected and diverted for beneficial <br />use in the Arkansas VoHey; PROVIDED, FURTHER, Tho' <br />such additional diversion sholl only be mode with <br />the mutual consent of each of the following agencies <br />of the State of Colorado, to wit: the Colorado Water <br />Conservation Board, the Southwestern Water Con- <br />servation District, the Colorado River Water Comerva- <br />tion District, and the Southeastern Colorado Water <br />Conservancy District. <br /> <br />19. UDALL <br />DATED DECEMBER 11, 1964 <br />RELATIVE TO THE WATER SERVICE CONTRACT <br />BETWEEN THE fEDERAL GOVERNMENT <br />AND THE SOUTHEASTERN COLORADO <br />WATER CONSERVANCY DISTRICT - <br />FRYINGPAN-ARKANSAS PROJECT <br /> <br />I. <br />I, <br /> <br />The Fryingpan-Arkonsas project, Colorado, is 0 <br />multiple purpose project authorized by 1he Act of <br />August 16, 1962 (76 Stat. 389). The project involves <br />transmountain diversion of water, thus reqUIring <br />features on both the east and west slopes of the <br />Continental Divide. Surplus water from the Colo- <br />rado River Basin will be diverted for use in the <br />Arkansas River Basin in Colorado. The imported <br />water, together with regulation of native Arkansas <br />River wafer, will provide supplemental irrigation sup- <br />plies, municipal and industrial water, and permit <br />power generation. Flood conlrol will be provided by <br />the terminal eastern slope reservoir on the Arkansas <br />River immediately above Pueblo, Colorado. The pro- <br />ject will be operated ond maintained by the United <br />Stotes in accordance with operating principles con- <br />tained in House Document 130, 87th Congress. <br /> <br />Pursuant to the Project Authorizing Act, con- <br />struction of the single-purpose municipal waler con- <br />veyance works by the United States will be under- <br />taken (a) only in the event the Secretory of the In- <br />tenor finds that it would be infeasible for the com- <br />munities involved to undertake such construction, and <br />(b) after the execution of contracts assuring repay- <br />ment of the cost of construction with interest within <br />50 years. <br /> <br />Construc1ion of the .project is currently es1imat- <br />cd to cost $169,905,000 including the estimated <br />$14,661,000 cost of municipal and industrial water <br />conveyance systems. The Authorizing Acl authorized <br />the appropriation of $170 million for construction of <br />the project. This amount is subiect to adjuslment 10 re- <br />flect fluctuations in construction cost as indicated by <br />engineering cost indexes applicable to the types of <br />construction involved. <br /> <br />7 <br />
