12. All lands acquired and held for project con-
struction and operation and water surfaces of pro-
ject reservoirs will be open to the public for recrea-
tional purposes, excepting those areas reserved by
the operoting agency.

13. The project will be operated in such a man-
ner that those in eastern Colorado using proiect water
imported from the Colorado River Basin for domestic
purposes sholl have preference over those claiming
or using water for any other purpose.

14. The project is to be operated in such a man-
ner os to secure the greatest benefit frol11 the use
and reuse of imported project woters within project
boundories in the State of Colorado.

18. No tronsmountain diversion of water sholl
ever be mode through the collection and diversion
system of Ihe Fryingpan.Arkonsas project in excess of
the quantitative limitations and conditions established
by this document. PROVIDED, HOWEVER, ThaI when,
under the lows of the State of Colorado, there may be
oddiiicnal wa'er avt.liloble for such collection and di.
version which is not at the time of diversion required
for beneficial use in western Colorado or for filling
interstate water compact agreements, then such
water may be collected and diverted for beneficial
use in the Arkansas VoHey; PROVIDED, FURTHER, Tho'
such additional diversion sholl only be mode with
the mutual consent of each of the following agencies
of the State of Colorado, to wit: the Colorado Water
Conservation Board, the Southwestern Water Con-
servation District, the Colorado River Water Comerva-
tion District, and the Southeastern Colorado Water
Conservancy District.

19. To assure project operation in conformity
with the operating principle heretofore stated, to
provide a means for the collection end interchange
of information, and to provide a method for the con~
tinued study of project operations to the end that,
jf the stated operating principles may be improved
upon, recommendations for changes may be made
to the contracting parties, 0 commission shall be
created in an appropriate manner to be composed of
one representative of the Southeastern Colorado
Water Conservancy District, one representative of the
Colorado River Water Conservation District, two
representatives of the United States, and one repre-
sentative of the State of Colorado appointed by the
Colorado Water Conservation Board after consulta-
tion wifh the Colorado Game and Fish Commission.
The powers of such commission shoJi be limited to
the collection of data, the making of findings of fact,
and the suggestion of changes in operating principles.

These operating principles shall be deemed to
have amended and take the place of those operating

WATER CONSERVANCY DISTRICT -
FRYINGPAN-ARKANSAS PROJECT

I.
I,

The Fryingpan-Arkonsas project, Colorado, is 0
multiple purpose project authorized by 1he Act of
August 16, 1962 (76 Stat. 389). The project involves
transmountain diversion of water, thus reqUIring
features on both the east and west slopes of the
Continental Divide. Surplus water from the Colo-
rado River Basin will be diverted for use in the
Arkansas River Basin in Colorado. The imported
water, together with regulation of native Arkansas
River wafer, will provide supplemental irrigation sup-
plies, municipal and industrial water, and permit
power generation. Flood conlrol will be provided by
the terminal eastern slope reservoir on the Arkansas
River immediately above Pueblo, Colorado. The pro-
ject will be operated ond maintained by the United
Stotes in accordance with operating principles con-
tained in House Document 130, 87th Congress.

Pursuant to the Project Authorizing Act, con-
struction of the single-purpose municipal waler con-
veyance works by the United States will be under-
taken (a) only in the event the Secretory of the In-
tenor finds that it would be infeasible for the com-
munities involved to undertake such construction, and
(b) after the execution of contracts assuring repay-
ment of the cost of construction with interest within
50 years.

Construc1ion of the .project is currently es1imat-
cd to cost $169,905,000 including the estimated
$14,661,000 cost of municipal and industrial water
conveyance systems. The Authorizing Acl authorized
the appropriation of $170 million for construction of
the project. This amount is subiect to adjuslment 10 re-
flect fluctuations in construction cost as indicated by
engineering cost indexes applicable to the types of
construction involved.
