Linkage <br /> <br />Come Now the States of Nebraska, Wyoming and Colorado and the United States <br />of America and hereby stipulate and agree as follows: <br /> <br />Whereas, in this case, the State of Nebraska has raised issues and alleged equities <br />relating to the environment and wildlife; and <br /> <br />Whereas, the parties to this litigation are not seeking to establish a specific <br />apportionment for threatened and endangered species, their habitat, or wildlife in general; <br />and <br /> <br />Whereas, the States of Nebraska, Wyoming and Colorado and the United States of <br />American have executed the "Memorandum of Agreement for Central Platte River Basin <br />Endangered Species Recovery Implementation Program (MOA)"; and <br /> <br />Whereas, the purpose of the MOA is to initiate the development of a mutually <br />acceptable Platte River Basin Endangered Species Recovery Implementation Program <br />(program) that would help conserve and recover federally listed species (target species); <br />the whooping crane, the interior least tern, the piping plover, and the pallid sturgeon; and <br />help protect and improve federally designated critical habitat in the Central Platte River <br />basin: and <br /> <br />Whereas, the parties are negotiating the "Cooperative Agreement for Platte River <br />Research and Other Efforts relating to Endangered Species Habitats along the Central <br />Platte River, Nebraska (Agreement)"; and <br /> <br />Whereas, the purpose of the Agreement is to implement certain aspects of the U.S. <br />Fish and Wildlife Service's recovery plans for the target species and the federally <br />designated critical habitat while the Program and alternatives to the Program are subjected <br />to review under the National Environmental Policy Act (NtP A) and the Endangered <br />Species Act (ESA); and <br /> <br />Whereas, the parties to this litigation do not want this case to be an impediment to <br />any potential agreement relative to the Program. <br />
