Linkage Come Now the States of Nebraska, Wyoming and Colorado and the United States of America and hereby stipulate and agree as follows: Whereas, in this case, the State of Nebraska has raised issues and alleged equities relating to the environment and wildlife; and Whereas, the parties to this litigation are not seeking to establish a specific apportionment for threatened and endangered species, their habitat, or wildlife in general; and Whereas, the States of Nebraska, Wyoming and Colorado and the United States of American have executed the "Memorandum of Agreement for Central Platte River Basin Endangered Species Recovery Implementation Program (MOA)"; and Whereas, the purpose of the MOA is to initiate the development of a mutually acceptable Platte River Basin Endangered Species Recovery Implementation Program (program) that would help conserve and recover federally listed species (target species); the whooping crane, the interior least tern, the piping plover, and the pallid sturgeon; and help protect and improve federally designated critical habitat in the Central Platte River basin: and Whereas, the parties are negotiating the "Cooperative Agreement for Platte River Research and Other Efforts relating to Endangered Species Habitats along the Central Platte River, Nebraska (Agreement)"; and Whereas, the purpose of the Agreement is to implement certain aspects of the U.S. Fish and Wildlife Service's recovery plans for the target species and the federally designated critical habitat while the Program and alternatives to the Program are subjected to review under the National Environmental Policy Act (NtP A) and the Endangered Species Act (ESA); and Whereas, the parties to this litigation do not want this case to be an impediment to any potential agreement relative to the Program.
