<br />COLORADO RIVER WATER <br />CONSERVATION DISTRICT <br /> <br />A BRIEF CHRONOLOGY <br />OF <br />WOLFORD MOUNTAIN RESERVOIR <br /> <br />1968 The Municipal Subdistrict of the Northern Colorado Water Conservancy District files for <br />conditional water rights for its planned Windy Gap Project on the Colorado River. <br /> <br />1972 Division 5 Water Court grants Windy Gap's water decrees. The Colorado River District and <br />others appealed the case to the Colorado Supreme Court because the Subdistrict's filing <br />failed to include basin of origin protections as required by the Conservancy District Act. <br /> <br />1979 Colorado Supreme Court reverses Water Court's decision and remands the Windy Gap case <br />back to the District Water Court. During the period set aside for petitions for rehearing, the <br />Subdistrict and the River District and other opponents meet and agree to resolve their <br />respective differences. <br /> <br />1980 The Subdistrict and the River District, along with other protesters, sign an agreement under <br />which the Subdistrict agrees to certain mitigation conditions to fulfill its <br />obligations under the Conservancy District Act including a compensatory storage reservoir <br />for West Slope use. The costs of permitting, design, and development of the specified <br />reservoir, Azure Reservoir and Power Project, are to be entirely the Subdistrict's. <br /> <br />1985 The Subdistrict, the River District, and others agree that the Azure Project can not be built <br />and that the Colorado River District will assume the Subdistrict's remaining obligations <br />under the Conservancy District Act iri retuin for $10.2 inillion. At this lime, a reservoir at <br />Rock Creek is envisioned. <br /> <br />1985 The River District applies to the US Forest Service for a Special Use Permit to construct and <br />operate a reservoir on Rock Creek. As part of the NEP A process, a reservoir on Muddy <br />Creek near Kremmling in Grand County is identified and evaluated as an alternative in the <br />Draft Environmental Impact Statement. <br /> <br />1987 The River District and the Denver Water Department enter into a lease agreement which <br />provides the District with the additional revenues necessary to finance construction of a <br />reservoir at either Rock Creek or Muddy Creek.
