<br />OGJ8t.:3 <br /> <br />M~!1QRaNDU!1 <br /> <br />TO: <br /> <br />Gene Jencsok <br />Dan Merriman <br />File <br /> <br />Steve Boand /Iff <br /> <br />FROM: <br /> <br />DATE: <br /> <br />June 6. 1986 <br /> <br />RE: <br /> <br />Wilderness Instream Flow APpropr,iation List <br /> <br />The attached lists show the 305 instream flow appropriations <br />held by the Colorado Water Conservation Board in existing and <br />candidate wilderness areas. These lists were developed by Mr. <br />Jim McDanold (of the State Engineer'S Office) and me by <br />locating all instream flow appropriations made by the CWCB as <br />of December 31, 1985 on U.S. Forest Service maps. The lists <br />show only those instream flow appropriations that begin in <br />wilderness areas. Stream segments that started just outside a <br />wilderness or proposed wilderness area were not included. <br />Those appropriations would however provide protection for those <br />wilderness streams since water would be pulled through the <br />wilderness to meet a downstream instream flow call. It should <br />also be noted that not all the appropriations shown on the <br />lists are decreed at this time. <br /> <br />The 79 instream flow appropraitions held in candidate <br />wilderness areas will be senior to any reserved right obtained <br />by the Federal government through reserved rights. Of the 226 <br />appropriations held by the CWCB in existing wilderness areas. <br />it is estimated that approximately 85 of those appropriations <br />would be senior to a federal reservation of water for instream <br />flow purposes. (The actual number of CWCB appropriations <br />senior to a federal reservation could vary between 62 and 105 <br />depending upon the establishment date for the portion of the <br />wilderness in which the CWCB instream flow appropriation is <br />loea ted. ) <br /> <br />Lastly, please note that these lists are based upon the <br />interpretations made by Jim McDanold and me. There were a <br />number of "close calls" that might be interpreted differently <br />by other individuals. <br /> <br />1014E <br />
