Draper <br />Special Assistant Attorney General, State of Kansas <br />Montgomery & Andrews <br />325 Paseo de Peralta <br />Santa Fe, NM 81501 <br />By Federal Express <br /> <br />RE: <br /> <br />ARCA Operations Committee meeting, February 23.24, Lamar, Colorado <br /> <br />Dear John: <br /> <br />This letter is to confirm our agreement, on behalf of the states of Colorado and Kansas, to certain. <br />ground rules for the meeting of the Arkansas River Compact Administration (AReA) Operations <br />Committee scheduled for February 23 and 24, 2000, in Lamar, Colorado. The states want this to <br />be an informational, technical meeting, without legal counsel in attendance. In order to promote <br />frank discussion among those present, the states agree to the following: <br /> <br />1. <br /> <br />No minutes, transcripts, or recordings of the meeting will be made. <br /> <br />2, <br /> <br />Neither state will attempt to obtain any personal notes taken by a representative of <br />the other state. <br /> <br />3. <br /> <br />Statements or personal notes made at the meeting, characterizations or <br />descriptions of the meeting, or materials prepared for or presented at the meeting <br />by a representative of the other state shall not be admissible in any administrative <br />or judicial proceeding without the consent of both states. This shall not apply to <br />materials previously prepared for and submitted to ARCA or to materials <br />otherwise available. <br /> <br />4. <br /> <br />The states' representatives are not authorized to make any findings or agreements. <br /> <br />This letter agreement shall be binding upon the states of Colorado and Kansas and their agents, <br />employees, experts, and representatives. <br /> <br />We request the chairman of the Operations Committee to read this letter at the start of the <br />meeting. <br />
