<br />. <br /> <br />. <br /> <br />Included in the Board folder are copies of (1) Governor Davis' tHlking points for his <br />December 6th press conference; and (2) Standard Agreement No. 34, proposed to be signed by the <br />Six Agency Committee Chairman and the Board's Executive Director, authorizing the expenditure <br />of the Six Agency Committee's contribution after the State's Share of$192,212 has been expended. <br /> <br />AGENCY MANAGERS MEETING <br /> <br />The Agency Managers' Technical Committee met on November 18, 2002, to discuss issues <br />related to Article V Decree accounting and mainstream water use by riparian vegetation associated <br />with environmental restoration programs. Discussions at this meeting and the California Caucus of <br />the Lower Colorado River Multi-Species Conservation Program (LCR MSCP) has resulted in the <br />development of a proposed policy to facilitate the implementation of proposed habitat and species <br />conservation measures along the Lower Colorado River. Included in the Board folder is a draft copy <br />of the proposed policy prepared by the Technical Committee entitled Proposed Policy for the <br />Determination of a Diminution of Supply from the Colorado River As Opposed to a Diversion From <br />and Consumptive Use of Mainstream Colorado River Water. <br /> <br />Generally, the proposed policy puts forward the position that actions taken by the Secretary <br />of the Interior, pursuant to existing authorities to control floods, improve navigation, and regulate <br />the flow of the Colorado River, including the implementation of appropriate conservation measures, <br />shall be considered as operation and control of the Colorado River in compliance with <br />Article IT(A)(1) of the Decree (in Arizona v. California). Such actions are distinct from a release of <br />mainstream water controlled by the United States under Article IT(A)(2) of the Decree for irrigation <br />and domestic uses and the satisfaction of present perfected rights. Accordingly, any reservoir <br />evaporation, channel. and other losses from the mainstream sustained as a result of: <br /> <br />I. The operation and control of the Colorado River; <br /> <br />2. Conservation measures implemented by Reclamation, pursuant to final biological <br />opinions and reasonable and prudent alternatives; and <br /> <br />3. Future conservation measures implemented pursuant to an approved final LCR MSCP; <br /> <br />are not chargeable to the states as a diversion or a consumptive use, but are to be treated as a <br />diminution of supply from the mainstream. <br /> <br />A meeting has been scheduled, by Reclamation on December 19th, to discuss the proposed <br />policy and related issues. The meeting will be held in Las Vegas, Nevada. Both Mr. Harris and I <br />will attend the meeting. <br /> <br />2 <br />
