The construction of Caddoa Projeot in Colorado has created problems, <br />by its looaticn, - which divides the appropriators along the Arkansas River <br />into ~10 groups, one above, represented by ditches in Water Districts 14 and <br />17, and the other below, involving ditches in Water Distriot 67; and by its <br />operations, which affect the relative rights of the two groups and of individ- <br />ual appropriators in Water District 67, and ths system of administerin~ de- <br />oreed rights and distributing water, long-established in Colorado, under its <br />doctrine of appropriation and rule of priority. }~y plan of operation assum- <br />ed or adopted should recognize that: <br /> <br />~ <br /> <br />(a) .1hen Caddoa Reservoir is empty, or unavailahle, and diversions <br />from the Arkansas River are being rr.ade from so-called "natural flows," the <br />'long-established system of adninistration and distribution will prevail. in <br />Colorado the same as if the Caddoa project had not been constructed; and at <br />such times the water sup~lies of ,the Arkansas River will bs apportioned as be- <br />tween District 67 and other districts upstream, and as bebreen the ditches of <br />District 67, in aoc'ordance ':rith their relative deoreed priori ties and needs <br />thereunder; <br /> <br />(b) When waters are impounded or stored in Caddon Reservoir, and <br />are t~us availablo for release, the decreed rights of ditches in District 67 <br />are deemed to be temporarily sntisfied, and at such times the appropriators <br />in District 67 may not call upon junior a~proprintors upstream for another <br />or second supply of water! <br /> <br />(0) In thc ahove mentioned v!ay a portion of Colorado's share of <br />any water made available for additional diversion and increased use by reason <br />of Caddoa Reservoir vall be diverted and used in Water Districts upstream <br />,from Caddoa, principally in Water Districts 14 and 17;___n_ _ __, .. _ ___ ____ ,,- <br /> <br />(d) 'When-releases "of water"from'Cadd~a:-Re,j~r:":oir are-made- f:or-' <br /> <br />'h_ " .,... <br /> <br />....i .
