<br />or ornamental arts.
<br />(1) "Occupancy" refers to use of lands
<br />as a site for any type of useful structure
<br />whatsoever.
<br />(j) "Outdoor recreation" includes, but
<br />Is not lim1ted to, hunting, fishing, trap-
<br />ping, photography. hiking, camping,
<br />swimming, boating, rock and mineral
<br />collecting, sightseeing, mountain cl1mb-
<br />Jng, and skiing.
<br />(k> "Timber production" refers to the
<br />growth of trees for wood.
<br />fl) "Wa.tershed protectton" refers to
<br />maintenance of the stab11lty of soll and
<br />sol1 cover and the control of the natural
<br />flow of water.
<br />(m) "Wilderness" refers to areas in a
<br />native condition or reverted to a natural
<br />condition, substantially free of man-
<br />made structures.
<br />(n) "PublIc value" refers to an asset
<br />held by, or a service performed for, or a
<br />benefit accruing to the people at large.
<br />(0) "Multiple use" means the man-
<br />agement of the various surface and sub-
<br />surface resources so that they are uti-
<br />lized in the combination that wlll best
<br />meet the present and future needs of the
<br />American people; the most judicious use
<br />of the land for some or all of these re-
<br />sources or related services over areas
<br />large enough to provide sumcient lati-
<br />tude for periOdic adjustments in use to
<br />conform to changing needs and condi-
<br />tions; the use of some land for less than
<br />all of the resources; and hannonious and
<br />coordinated management of the various
<br />resources, each with the other, without
<br />Impairment of the productivity of the
<br />land, with consideration being given to
<br />the relative values of the various re-
<br />sources, and not necessarily the com-
<br />bination of uses that will give the greatest
<br />dollar return or the greatest unit output.
<br />(p) "Sustained yield of the several
<br />products and services" means the
<br />achievement and maintenance of a hlgh-
<br />level annual or regular periodic output
<br />of the various renewable resources of
<br />land without impainnent of the produc-
<br />t1vity of the land.

<br />(a) All classifications under the regu-
<br />lations of this part must be consistent
<br />with all the followlng criteria:
<br />(1) The lands must be phYSically suit-
<br />able or adaptable to the uses or pur-
<br />poses for which they are class11led. In
<br />addition, they must have such physical
<br />and other characteristics as the law may
<br />require them to have to qualify for a
<br />particular classification.
<br />(2) AU present and potential uses ~d
<br />users of the lands will be taken Into con-
<br />sideration. All other thingS being equal,
<br />land classifications will attempt to
<br />achieve maximum future uses and mini-
<br />mum disturbance to eXisting users.
<br />(3) To the extent they are not incon~
<br />slstent with Federal programs, poltcies.
<br />and uses, and will not lead to Inequities
<br />among private individuals, aU land clas-
<br />s11lcations must be consistent with State
<br />and local government programs, plans,
<br />

<br />zoning, and regulations applicable to the
<br />area in which the lands to be classified
<br />are located.
<br />(4) All land classifications must be
<br />consistent with programs and policies
<br />established by the Congress, or the Presi-
<br />dent, to the extent that those poHci.es
<br />would affect the use or disposal of the
<br />public lands.
<br />(b) When, under the criteria of this
<br />part, a tract of land could be classified
<br />lor either retention for multiple use man-
<br />agement, or for some form of disposal.
<br />the relative scarCity of the values In-
<br />volved and the availability of alterna-
<br />tive means and sites for realization of
<br />those values will be c9l1sidered. The
<br />tract will then be classlfled in a manner
<br />which will provide the maximum benefit
<br />for the general public.

<br />
<br />In addition to the general criteria in
<br />~ 2410.1-1. the fOllowing criteria w1ll gov-
<br />ern classifications for retention in Fed-
<br />eral ownership for multiple use manage-
<br />ment under the Classification and Mul-
<br />tiple Use Act of September 19, 1964 (78
<br />Stat, 986. 43 U,s'C, 1411-18>' Retention
<br />and management classifl.cations under
<br />this act will expire on June 30, 1969, ex-
<br />cept as otherwise provided In section 8
<br />of the act. To be classified for retention
<br />and then committed to multiple use-
<br />sustained yield management under sec-
<br />tion 3 of the act, public lands must have
<br />:value for one or more of the fOllowing
<br />purposes:
<br />(a) Domestic livestock grazing. Do-
<br />mestic livestock grazing management in-
<br />volves the protectIon, use, and develop-
<br />ment of forage prodUCing public lands
<br />and the management of livestock use to
<br />obtaln a sustained yield of forage and
<br />liVestock products, in accordance with
<br />the provision ot applicable laws, such
<br />as the Taylor Grazing Act, as amended
<br />(43 U.s,C, 315-315r), and the Alaska
<br />GrazIng Act (48 U,S,C, 471-4710). Pub-
<br />lic lands may be retained for multiple
<br />use management it such retention wUl-
<br />(1) Stabilize the livestock industry
<br />dependent on Federal lands. or
<br />(2) Assure effectIve and economical
<br />administration of Federal grazing lands.
<br />(b) Fish and wildlife development ana
<br />utilization. Fish and wildlife develop-
<br />ment and utilization involves the man-
<br />agement and development of habitat to
<br />obtain a sustained yield of fish and wild-
<br />life. and the provision of access for the
<br />utilization of fish and wildlife, under ap-
<br />propriate coordination with interested
<br />private landowners, and State and Fed-
<br />eral agencies, under provisIons of appli-
<br />cable laws, such as section 9 of the Taylor
<br />Grazing Act, as amended (43 U.S.C.
<br />315h) and the Fish and Wildlife Coordi-
<br />nation Act, as amended (16 U .S.C. 661-
<br />666c). Publ1c lands may be retained for
<br />multiple use management 1! such reten-
<br />tion will-
<br />(1) __Provide an area of hunting and
<br />:tl.shing ground for the general public,
<br />or
<br />(2) MaIntain habitat and food sup-
<br />ply for the :fish and wUdl1fe population
<br />dependent upon the publ1c lands and
<br />being mainta.ined under Federal and
<br />State programs, or
<br />
<br />(3) Preserve the habitat of any en-
<br />dangered species factng pOSSible exter-
<br />mination from an important life zone of
<br />natural occurrence.
<br />(c) Industrial development. Indus-
<br />trial development Involves any use or
<br />requirement related to industry. on
<br />either short. term or long-term basis.
<br />Public lands may be retained for multiple
<br />use management if such retention wlll-
<br />(1) Protect resource values, inclUding
<br />water, on the land so managed when the
<br />industrial use or development Is made on
<br />a non-exclusive or short-term basis, or
<br />(2) Protect Federal lands and waters
<br />adja.cent to the land being used for in-
<br />dustrial purposes, when the industrial
<br />use or development Is of a long term
<br />and exclusive nature. by means of use
<br />stipulations Bnd other techniques which
<br />could not be used If the land had passed
<br />to non-Federal ownership.
<br />(d) Mineral production. M i n era I
<br />production Involves any use related to
<br />the extraction and processing of locat-
<br />able and leasable minerals and saleable
<br />mineral materials. Multiple use con-
<br />templates development and management
<br />of the various surface and subsurface
<br />resources in a combination that wlll--best
<br />meet the present and future needs of the
<br />American people. Under the following
<br />circumstances, lands will be retained in
<br />Federal ownership to permit manage-
<br />ment for multiple use, inCluding mineral
<br />production,
<br />(1) When prescribed by law, and
<br />(2) When necessary to protect publiC
<br />values.
<br />(e) Occupancy. Occupancy involves
<br />the use of public lands. on either part-
<br />time or full.t1me basis for any type of
<br />useful structure. Lands may be retained
<br />for multiple use management if such re-
<br />tention w1l1-
<br />(1) Protect other resource values on
<br />"the land and on adjacent Federal lands
<br />when occupancy is made on a nonex-
<br />clusive or short-term basis, or
<br />(2) Protect adjacent Federal lands, by
<br />means of use stipulations and other tech-
<br />niques which could not be used 1! the
<br />land had passed to non-Federal owner-
<br />ship, when the occupancy is of long term
<br />and exclusive nature.
<br />(f) Outdoor recreation. Outdoor rec-
<br />reation involves the protection, preserva-
<br />tion, development, publlc use, and en-
<br />joyment of scenery, water, primitive or
<br />natural landscape (including raadless
<br />areas). wUdlife, natural phenomena. (1.e.,
<br />petrified wood), Bnd archeological and
<br />historical sites. Such activities are de-
<br />signed to further national program for
<br />the provision of necessary recreational.
<br />conservation and scenic areas and open
<br />space (42 U.S.C. 1500), and for the as-
<br />surance of outdoor recreation resources
<br />for present and future generations of
<br />Americans (16 U.S.C. 460:1-3), Recre-
<br />ation management will provide for pub~
<br />lie access to public lands, for construction
<br />of recreation facilities where needed, and
<br />to the extent practicable, for protection
<br />of the health and safety of the using pub-
<br />lic. Lands may be retaIned for multiple
<br />use management 1! such retention will-
<br />(1) Provide sItes for construction of
<br />recreation facUitles needed to Insure the
<br />sanitation and protection of publlc land
