Repayment of the remaining 601. allo- <br />cated to irrigation la covered by contract dated March 31, 1949 <br />between the >Jnlted states ond the Conejos Water Conservancy District. <br />Article :5 thereof recognizes the npplic.obllitl of Section 7 of the <br />Flood Control Act of 1944 (58 stat. a90). Soid section reads In <br />pertinent part as follows. <br /> <br />"It shall be the duty of the Secretery of War <br />(Secretary of the Army) to prescribe regulations <br />for the use of storage allocatad for flood control <br />or navigation at all reservoirs constructed wholly <br />or in part with Federsl funds provided on the basis <br />of such purposes, and the ope-rat1on of' any such <br />project shell be In accordance wIth such regulations." <br /> <br />In view of the prospect of high flood flows 00 the Cooejos <br />River during the flood season of 1952 it is hereby agreed betceen <br />the Bureau of Reclamation and the Corps of ~ngineere that regula- <br />tions governing operation of Platoro 1)"", and Raserovoir to control <br />thoae floods should bs adopted. <br /> <br />It is therefore agreed that the attachment identified as <br />Part 2OS-Flood Control rtegulations Platoro Dam and Reservoir, <br />Conejos River, Colorado, shall be adopted and followed during <br />the flood sesson of 1952. <br /> <br />This Memorandum shell not be considered as being applic- <br />able to any sesson beyond the calendar lear 1952. <br /> <br />This Memorandum of Understanding 1s executed sa of this <br />day of 1952. <br /> <br />Regional Director, Region 5 <br />Bureau of Beolsmation <br />Atr.& rillo..
