<br />0005~9 <br /> <br />" <br /> <br />SECTION 7: Restrictions on Water Resources Projects <br /> <br />7.1 What is meant by the term "water resource project"? <br /> <br />A water resources project is defined n:; "... any type of construction <br />which would result in any change in thc free-flowing characteristics <br />of a particular river." Permi ts to dredge or fill a river channel <br />would be a water resources project, as would be sewage treatment <br />plants. Crossings for gas pipelines or transmission lines or bridge <br />and road construction projects normally would not be water resources <br />projects. (February 7, 1969) , <br /> <br />7.2 To what extent is the Federal Power Commission's licensing authority <br />curtailed by section 7? <br /> <br />Section 7 prohibits the Federal Power Commission from licensing any <br />n~ projects or construction, even as an incident to an existing dam <br />'-or project, which would be "on" or "directly affecting" any of the <br />ri~ers listed in section 3 and sectiort-5-of the Act, regardless of <br />whether the project is presently under license fro~ the Commission. <br />The language of section 7 does not, however, preclude the Commission <br />from licensing existing projects that are presently unlicensed, so <br />long as Commission action does not authorize any new construction. <br />(February 7, 1969) <br /> <br />7.3 Who determines whether a Federal Power Commission license or a water <br />resources project involving Federal assistance would have an adverse <br />effect on a river? <br /> <br />The Secretary charged with administration of a wild or scenic river or <br />responsible' for the study of a section 5 river.
