Chief Engineer; <br /> <br />'. <br /> <br />ReI Dispute Concerning Interstate Administration <br />of Arkansas River and Caddoa Reservoir Dur- <br />ing Months of April to July incl. of 1943. <br /> <br />, <br /> <br />The dispute between State Engineer Hinucrlider of Colorado and <br /> <br />Engineer Knapp of Kansas was discussed at the meeting of August 19th be- <br /> <br />tween Attorneys General Ireland of Colorado and Mitchell of Kansas. also <br /> <br />attended by Colorado Attorneys HcHendrie. Vidal and Breitenstein. Fig- <br /> <br />ures submitted by Mr. Knapp (attached Table 1) purport to show that. as <br /> <br />of August 1. 1943. Kansas had a balanoe in its so-called "surplus" ac- <br /> <br />count of about 11.000 A. F. Based thereon he had requested that 6lIlount <br /> <br />of water plus 4.000 A. F. as its estimated August "quota". or a total of <br /> <br />15.000 A.F. for delivery at the Stateline during August 1943. t~. Hin- <br /> <br />derlider had refused to make the requested August deliveries, contending <br /> <br /> <br />that. under his interpretation of the agreement between the too States <br /> <br /> <br />(Stipulation of 1933). Colorado had delivered during the months of April, <br /> <br />May, June and July. 1943, some 2.000 A.F. of water in exoess of the share <br /> <br />I: r <br />,} e <br />II f <br /> <br />to whioh Kansas was entitled (attaohed Table 2). Hr. Hinderlider stated <br /> <br />that. unless direoted otherwise by Attorney General Ireland. he proposed <br /> <br />to make up the said over-deliveries of the previous four months by re- <br /> <br />duoing the quantities delivered to Kansas in the two remaining months of <br /> <br />the 1943 irrigation season below the Kansas "quotas" for said months. <br /> <br />lIithout attempting, at the said meeting of August 19th. to <br /> <br />l <br />
