In this section of the report we <br /> <br /> <br />have set out the major allegations, our conclusion regarding each <br /> <br /> <br />one, and a description of our investigation in each case. In sum- <br /> <br /> <br />mary, the allegations and our conclusions as to each are as <br /> <br /> <br />follows: <br /> <br />III-A. THE FORT MORGAN GOLF COURSE WELL EPISODE <br />1. Allegations <br />Many of the complaints against John L. Samples seem to center <br />around an episode in which he attempted to shut down the well <br />owned by the City of Fort Morgan, used by it to irrigate its muni- <br />cipal golf course. Some of the complaints alleged that he tried <br />to sell replacement water to the City of Fort Morgan. <br />2. Conclusion <br />It is our conclusion that John L. Samples did not act in a <br />diplomatic way when dealing with the Fort Morgan city council; <br />that he was acting properly in warning the city council about the <br />effects of H. B. 1066 on its wells; and that he was acting properly <br />in suggesting a means (the purchase or lease of water rights) for <br />dea li ng wi th the si tua ti on. <br />We conclude further that he probably had in mind acting as a <br />"go-between" in obtaining water for the city from Senator Frank L. <br />"Ted" Gill.
