Ladies and Gentlemen:

I am returning to you House Bill 91-1176, "ConceT'ning the
Creation of a Claim for Relief for the Disparagement of
Perishable Agricultural Food Products," which I vetoed on April
29, 1991, at 1:15 p.m.

I am vetoing this bill because I believe it would unduly
Inhibit free speech. I also believe it would hamper research
and particularly the publication of research on .health Issues
relating to foods. I~ is. not just what the bill does~ but the
intimidation that could arise out of what people think the bill
does that would put an excessive damper on these activities..

I am aware of the problems that unsubstantiated rumors can
cause in relation to. food products. However, I believe that we
can solve those problems In ways that do not interfere with
free speech.

Therefore, I . today. am issuing an executive order, formally
creating a Colorado Task Force on Food Safety. This task
force, which Is the outgrowth of a group launched a year ago by
the Colorado Department of Agriculture, will assist the public
in sorting fact from fiction when issues are raised about the
safety of a food product. In addition, the task force will
develop a state response plan for any future food safety
crisis.

I take thi s act Ion after much refl ect ion. I hold deep respect
for the agricultural industry and its contribution to
Colorado's social and economic fabric. I also understand the
damage caused by uninformed challenges to the wholesomeness of
food products.

HoweveT', I also value the freedom of speech guaranteed to
American citizens. That constitutional protection gives
individuals as well as consumer groups and researchers the
guaranteed right to raise legitimate questions about food
safety and quality. It is vital that agriculture professionals
and consumers continue to have rational and meaningful
exchanges about food production and nutrition.
