Mr. Tipton was quite frank <br />in his position with respect to the saline quality of <br />that water, and his statement was that he had been present <br />at conferences of the negotiators of the particular treaty <br />before us at El Paso, where they spent 43 days in discuss- <br />ing and going over the treaty and arriving at its terms <br />and language and he advised us very pointedly to the <br />effect that the precise words "from any and all soorces" <br />were put in this treaty at the place where they are with <br />the intent and purpose and the specific understanding <br />that we would require Mexico to take this return flow <br />regardless of the quantity of salt that might be in it. <br /> <br />SENATOR MURDOCK. It seems to me that the testimony <br />of Mr. Tipton was that that clause in article lO referred <br />to the source of water; that is, regardless of the source <br />they could be supplied from in filling this allotment to <br />Mexico. Then he went to the other clause, "for any purpose <br />whatsoever", as having to do with the quality of water. Is <br />not that the statement he made? <br /> <br />MR. HORTON. He made two statements. He attempted to <br />justify his position that Mexico was and would be required <br />under the treaty to take salt water or water unfit for <br />use. But I want to call your attention to an additional <br />statement that Mr. Tipton made. <br /> <br />THE CHAIRMAN. I want to call your attention to part <br />of the language of article lO(b): <br /> <br />Mexico shall acquire no right beyond that pro- <br />vided by this subparagraph by the use of the waters <br />of the Colorado River system, for any purpose what- <br />soever, in excess of 1,500,000 acre-feet. <br /> <br />MR. HORTON. I think that phrase is the same one that <br />the Senator just referred to. <br /> <br />THE CHAIRMAN. I beg your pardon. <br /> <br />MR. HORTON. Mr. Tipton in analyzing that has made the <br />statement that "any and all sources" was put in there for <br />the purpose of having reference to the salt content. Then <br />he referred to the provision that Senator Connally and <br />Senator Murdock have just referred to in subdivision (b) <br />of article lO; but on cross-examination, if you want to <br /> <br />-34- <br />
