<br />MR. TIPTON. Yes, sir. It is being used in Sonora at <br />the present time, but I do not know what the quality of <br />the return itself would be, because mixed with the return <br />proper there are the so-called regulation returns. In <br />other words, waste water which is carried through the <br />canal system, of the same quality as the water which is <br />originally diverted from the stream. <br /> <br />SENATOR DOTtlNEY. Then let me ask you this: Would the <br />character or quality of that water as you would expect it <br />to be returned be what you would characterize as "usable"? <br /> <br />MR. TIPTON. From this area, I think so, Senator. <br /> <br />SENATOR McFARLAND. Hhat is the percentage of the salt <br />content of the water that is being diverted at the <br />present time for use upon this land? <br /> <br />MR. TIPTON. I do not believe I can answer that at <br />the moment. I think it is around 500 to 600 parts per <br />million, but I am not sure about that, Senator. <br /> <br />SENATOR McFARLAND. Well, that is very good water? <br /> <br />MR. TIPTON. Yes; that is very good water." <br /> <br />P. 322 to middle of P. 323: <br /> <br />"SENATOR DOvlNEY. Mr. Tipton, is there any statement <br />in the treaty as to the quality of water that must be <br />delivered by the United states to Mexico? <br /> <br />MR. TIPTON. We are protected on the quality, sir. <br /> <br />SENATOR DOWNEY. That is, you would mean by that <br />statement that we could perform the terms of our treaty <br />with Mexico by delivering to her water that would not be <br />usable? <br /> <br />MR. TIPTON. Yes, sir. <br /> <br />SENATOR DOl'1NEY. And you think that some court in the <br />future would uphold that kind of interpretation, that we <br />could satisfy in whole or in part our obligation to Mexico <br />under this treaty of delivering 1,500,000 acre-feet of <br />water, even though some or all of it were not usable for <br />irrigation purposes? <br /> <br />-25- <br />
