<br />I <br /> <br />Article 12 <br /> <br />Article 12(a) provides that Mexico shall construct, at <br />its expense, a main diversion structure in the river below the <br />upper international boundary. This is the structure which we now <br />call Morelos Dam. This structure is needed, of course, to permit <br />the utilization of drainage and return flows from the united states <br />which, as previously stated, form a major part of Mexico's alloca- <br />tions. Provision is also made for the construction at Mexico's <br />expense of such levees, interior drainage facilities, and other <br />works as may be necessary to protect lands within the United states <br />against damage from floods and seepages as might result from the <br />construction and operation of the diversion structure. <br /> <br />Article 12(b) provides for the construction by the <br />United States of Davis Dam and Reservoir which is needed in part <br />to make possible the regulation at the boundary of waters to be <br />delivered to Mexico. Said Davis Dam has since been constructed <br />and is operated by the Bureau of Reclamation. The United states <br />section of the commission furnishes to the officials of the Bureau <br />of Reclamation the annual schedules of delivery that are presented <br />by the Mexican section and the Bureau so operates Davis Dam as to <br />make available to Mexico at the boundaries the waters to be de- <br />livered in the quantities and at the times called for by the <br />schedules. Similarly the Bureau of Reclamation operates Imperial <br />Dam in the Imperial Dam-pilot Knob reach of the All-American <br />Canal so as to insure compliance with the Mexican schedules for <br />the delivery of waters at the boundary line by means of the All- <br />American Canal. <br /> <br />Paragraph (c) provides for the construction by the United <br />states, within its own territory, of any other works that may be <br />necessary to convey the waters to Mexico referred to in the Treaty. <br />These works would be operated and maintained at Mexico's expense. <br /> <br />Paragraph (d) of Article 12 provides for the construc- <br />tion and operation of gaging stations on the river and other <br />facilities needed to keep a record of the flow of the river and <br />the waters so delivered to Mexico. <br /> <br />Article 13 <br /> <br />Article 13 provides that the commission shall investigate <br />and prepare plans for flood control on the lower Colorado River <br />between Imperial Dam and the Gulf of Mexico. There is no obliga- <br />tion on the part of either government to construct any flood <br /> <br />-9- <br />
