<br />r.l" ~ :1?' <br />'_~L . tJ...'1 <br /> <br />As a result of the direction included in S. 1029, a memorandum of understanding was <br />executed in September, 1991 between the State of Colorado, acting through the Colorado <br />Water Conservation Board, and the United States of America, acting through the Department <br />of Agriculture - Forest Service. The memorandum established the basis for cooperation in <br />data collection and analysis among the Forest Service and State agencies. <br /> <br />Field data and information were collected during September and October, 1991 by the Water <br />Conservation Board staff, the Division of Wildlife, and the Forest Service. Data analysis and <br />preparation of this report were done from October, 1991 through January, 1992. Although <br />information was collected at many locations within the watershed, the short timeframe allowed <br />for this project precluded collection of comprehensive resource information and direct <br />measurement of the full range of streamflows occurring in the Piedra River and its tributaries. <br />Other sources of information used during data analysis and development of the recommended <br />claim included USGS gage station records (piedra River at Piedra, Piedra River at Bridge <br />Ranger Station, Weminuche and Williams Creeks at Bridge Ranger Station, and San Juan River <br />at Pagosa Springs), a 1989 basinwide survey of the aquatic habitat of the Piedra River from <br />above Highway 160 to First Fork done under contract for the San Juan National Forest, and <br />personal knowledge of the area on the pan of Division of Wildlife, Division of Water <br />Resources, and Forest Service personnel. <br /> <br />The following sections describe the physical and biological setting of the Piedra River <br />watershed and river corridor, water related wilderness factors which were used to identify and <br />quantify the instream flow needs for the Piedra River and its tributaries within the proposed <br />wilderness, and the instream flow claim recommended by the Forest Service in consultation <br />with the Division of Wildlife. <br /> <br />The claim recommended in this report results from an assessment of the water related <br />resources and values of the Piedra River and its tributaries within the proposed Piedra <br />Wilderness. The instream flow requirements of these resources include both low and high <br />flow components. Based upon current knowledge of physical and biological systems the <br />recommended claim, which mimics the existing pattern of streamflow, would maintain the <br />interaction of processes which have shaped the Piedra River and its ecosystems and would <br />adequately protect the water related wilderness resources and values. <br /> <br />Section 3(e) of S. 1029 states that "nothing in this title shall affect or limit the use or <br />development by holders of valid water rights of Colorado's full apportionment" of water <br />allocated under interstate compacts or equitable apportionment decrees. The claim is <br />recommended within the context of the State of Colorado's priority system for water rights and <br />would therefore be junior to all existing absolute and conditional rights. <br /> <br />This report has been prepared to comply with the spirit and intent of S. 1029 for the specific <br />purposes only of quantifying, and quieting title to, instream flows adequate to protect <br />wilderness values in the proposed Piedra Wilderness. The State of Colorado and the United <br />States specifically reserve any and all other rights and defenses. <br /> <br />The report does not purpOrt to reflect, nor should it be construed to reflect, the United States' <br />or the State of Colorado's position on any other matter, including but not limited to federal <br />land management or water rights, in any other action, adjudication, or proceeding. <br /> <br />Page 2 <br />
