<br />fined in the applicable standard. Sec-
<br />ondly, EPA will decide whether the low-
<br />noise-emission product is suitable for use
<br />as a substitute for a type of product at
<br />that time in use by agencies of the Fed-
<br />eral Goverrunent. If the product is found
<br />suitable, the Administrator will Issue a
<br />certificate for that product, effective for
<br />a period of 1 year from the date of issu-
<br />ance. Thirdly. the Administrator of Gen-
<br />eral Services will determine if the certi-
<br />fied product has a price to be paid by
<br />the government which is no more than
<br />125 per centum of the retail price of the
<br />least expensive type of product for
<br />which it would be substItuted. If the 10\\1-
<br />noise-emission product meets this final
<br />requirement. it will be acquired by pur-
<br />chase or lease by the Federal Govern-
<br />ment for use by the Federal Government
<br />in Heu of the products for which it is a
<br />suitable substitute. The Administrator of
<br />GSA will promulgate separate proce-
<br />dures prescribing the circumstances
<br />under which the various Federal agencies
<br />will be required to purchase certified
<br />low-noise-emission products.
<br />The proposed regulations which follow
<br />pertain to the first two of these steps. It
<br />115 intended at this time that tlle low-
<br />noise-emissJon product criterion for any
<br />prOduct or class of products will be issued
<br />concurrentlY with the Federal noise
<br />source rmission standard for that prod-
<br />uct or class of products promulgated pur-
<br />suant to section 6 of the act. Specific
<br />data requirenlents necessary for deciding
<br />whether the product Is a "suitable sub-
<br />stitute" will be published separately from
<br />the low-noise-emission product critenon.
<br />Subsection b(3) of section 15 of the act
<br />prOVides that the Administrator may es-
<br />tablish a-low~noise-emlssion product ad-
<br />visory committee. The proposed regula-
<br />tions provide for such a committee to be
<br />composed of the Administrator of the
<br />Environmental Protection Agency, or his
<br />designee, representatives of Federal agen-
<br />cies, and private individuals.

<br />part, other than opacity standards, shall
<br />be determined only by the performance

<br />(b) Compliance with opacity stand-
<br />ards in this part shall be determined by
<br />use of Test Method 9 of the appendix.
<br />(c) The opacity standards set forth
<br />in this part shall apply at all times ex-
<br />cept during periods of startup, shutdown,
<br />malfunction, and as otherwise provided
<br />in the applicable standard.
<br />(d) At all times, including periOds of
<br />startup, shutdown, and malfunction,
<br />owners and operators shall, to the extent
<br />practicable. maintain and operate any
<br />affected facilit}' in a manner consistent
<br />with operations during the most recent
<br />performance test indicating compliance.
<br />Determination of whether acceptable
<br />operating and maintenance procedures
<br />are being used will be based on infonna-
<br />tion available to the Administrator which
<br />may include, but is not limited to, moni-
<br />toring results. opacity observations, re-
<br />view of operating and maintenance pro-
<br />cedures, and inspection of the source.

<br />Proposed Certification Procedures
<br />
<br />The Environmental ProtecUon Agency
<br />proposes to establish a new part 203 of
<br />title 40 of the Code of Federal Regula-
<br />tions (40 CPR 203.1 through 203.9).
<br />Section 15 of the Noise Control Act of
<br />1972, PUblic Law 92-574, 86 Stat. 1234,
<br />established a process Wlder which the
<br />Federal Government wi~l give preference
<br />in its purchasing to products who.'jle, noise
<br />emissions are significantly 10w~1" than
<br />those required by the Federal noise
<br />source emission sta.nda.rds, promulgated
<br />pursuant to section 6 of the act. in effect
<br />at the time of procurement.
<br />The process involves three steps.
<br />First. EP A will determine upon receipt
<br />of a properly filed certification applica-
