<br />Sec. 2 Jurisdiclion.

<br />The jurisdIction of the Oil Import Ap-
<br />peaJ.s Board is set out In section 5 of the
<br />Proclamation 4210, and 15 implemented
<br />by section 21 of the Oil Import reguIa~
<br />tions of the Secretary of the Interior of
<br />May 2. 1973 (38 F'R 10811).

<br />bility for appropriate allevtation of the
<br />supply problem of the established inde-
<br />pendent elements of the petroleum in-
<br />dustry, Including refiners, marketers.
<br />and jobbers, under the general direction
<br />of the Chairman of the 011 Import Pol-
<br />icy Committee.

<br />(a) Persons affected by the Oil Import
<br />regulations may petition the Oil Import
<br />Appeals Board for such relief as is within
<br />its jUflsd1ction as set out in section 21
<br />of the Oil Import regulations, In its
<br />evaluation of petitioners' requests the
<br />Board will consider the following guide-
<br />lines a.s may be appropriate. A peti.
<br />tioner:
<br />(1) Must be established and in opera-
<br />tion:
<br />(2) Must demonstrate that its to~a.l oil
<br />operations are not prodUCing a reason.
<br />able profit but did so in the past;
<br />(3) Must be unable to obtain sufficient
<br />supply at economic prices to meet its
<br />normal requirements;
<br />(4) Must demonstrate that it has
<br />made diligent efforts to obtain needed
<br />supplies:
<br />(5) Must demonstrate that paymen t of
<br />the license fee will cause it an exceptional
<br />hardship;
<br />(6) If possessing an import capability,
<br />must demonstrate to the .satisfaction of
<br />the Board that it is not feasible for it to
<br />alleviate its hardship by means of ex.
<br />change agreements involVing the use of
<br />licenses already granted to others who
<br />do not have an import capability:
<br />(7) Must demonstrate to the satisfac-
<br />tion of the Board its abiUty to uWtze im-
<br />port. allocations to obta.i.n s1lJ:)plies
<br />throulh license exchange or direct im-
<br />port;
<br />(8) If in control or possession of
<br />domestic crude oil production, must agree
<br />to make suppHes of crude all available In
<br />reasonable quantities and at economic
<br />

<br />prices, to established Independent cus.
<br />tomers;
<br />(9) II In the business of Wholesaling
<br />products to reseUers. must agree to make
<br />supplies of products available in reason-
<br />able Quantities and at economic prices, to
<br />est.abllshed independent customers;
<br />(10) Must demonstrate that it is tak-
<br />Ing, or planning to take, effective action
<br />to establish an econOmically feasible sup-
<br />ply to maintain its operations.
<br />(b) In making determinations on ex-
<br />ceptional hardships, the Board will con.
<br />sider, among other things. the si tuation
<br />of the petitioner's customers and of the
<br />community concerned as well as the pub-
<br />lic interest In preserving the independ.
<br />ent segment of the petroleum industry.
