If the project storage is so full that water must be <br /> <br />released and cannot be recaptured in lower project reservoirs, the accrued <br /> <br />debits of New Mexico and Colorado will be eliminated. [n addition, if <br /> <br />the aggregate accl'ued debits of Col(1I"a<lo and N,.w Mexico ,'xc",'d !.lit. llllf! 11ed <br /> <br />capacity of project storage, the accrued debits will be reduced accordingly. <br /> <br />Finally, the accrued credits and accrued debits will be reduced annually <br /> <br />to compensate for evaporation losses sustained in certain designed project <br />storage reservoirs. <br /> <br />Article VII prohibits either Colorado or New r1exico from increasing <br /> <br />the amount of water stored in reservoirs constructed after 1929 whenever <br /> <br />there is less than 400,000 acre feet of usable water in project storage. <br />But if actual releases from either the effective date of the Compact or <br />the calendar year following an actual spill are more than an average of <br />790,000 acre feet per annum, the minimum amount of storage in Elephant <br /> <br />Butte Reservoir shall be adjusted to reflect the excess. <br /> <br /> <br />Article VIII permits both Texas and New Mexico, during the month of <br /> <br />January, to demand the release of water ins torage reservoi rs constructed <br /> <br />after 1929. up to the amount of the accrued debits, and the releases shall <br /> <br />be in sufficient quantities to bring the amount of usable water in project <br /> <br />storage up to 600,000 acre feet by March 1 and to maintain that amount in <br />storage until April 13. This provision is designed to permit the normal <br />release of 790,000 acre feet of water from project storage each year. <br />Article IX contains Colorado's consent to the importation by New Mexico <br />or by the federal government of water from the San Juan River, provided <br />that present and prospective uses in Colorado of such water and its tri- <br />butaries are protected. <br />
