<br />the right to destroy it. whereas, if the District owns 1/3, this water will still be
<br />available to the River. McCurdy stated that the interest of the Directors should
<br />be "keeping the River whole II , and that the Directors must be in a position to tell
<br />their constituents what "will" happen, rather than what "canl! happen. He also
<br />observed, it is important that the Directors not foyce their constituents into a
<br />Court.Action if the same information can be obtained by the District and CF&I
<br />mutually. Beise observed that the Contract as drawn is very reasonable, and
<br />affords many opportunities for review at regular intervals, with the Distl'ict re-
<br />serving the right to withdraw if it is determined the agreement i6 110t in the best
<br />interest of the District. He assured the Board he would notify them of any prob-
<br />lems, should they arise.

<br />President Nichols asked the Board if they wished to reaffirm the Resolution ad-
<br />opted at the January 12, 1967 meeting. All present agreed. Mr. Bauserman
<br />asked that copies of the proposed agreement be Sent to the Presidents of Ditch
<br />Companies along the River, for their early observations. Mr. Beise alBo stated
<br />that the CF&I Board wUl have to app"to\1e this agreement at their March meeting.
<br />thus assuring ample time for the Ditch Companies to register their observations.

<br />Le~al Committee: Chairrna.~ Beise stated that during the past month, the Legal
<br />Committee has been involved in the following: 1. CF&.I Contract negotiations.
<br />2. Preparation and conduct. of the oral argument in District Court on District
<br />#14 adjudication, January 19, 1967. 3. Preparation for the Harvey vs District
<br />Case in District # 12. March 9. 1967. 4. Prepayation of letter recommending
<br />the nomination of Andy Riter for the Chairmanship of the Arkansas River Com-
<br />pact Commission. 5. Cursory study of legislation involving water-related bills.
<br />6. Attendance at Ground Water Commission Meetings. January 2.6 and 27. 1967.
<br />7. A rneeting with Al Burtis, of the La Junta Tribune~Democrat; Milton Booth,
<br />Arka.nsas Valley Journal; and General Manager Thomson, on February 2, 1967,
<br />relative to a number of legal and operational points involving the District and the
<br />Project.

<br />Legislative Committee: Chairman Frank Dilley reported on the following: 1.
<br />The Committee met with Larry Sparks, Executive Director of the Colorado Water
<br />Conservation Board, on February 8, 1967 to discuss the proposed water-related
<br />legidation now being developed by the Colorado Water Conservation Board. He
<br />stated that the Saunders proposal is still in very rough form, and the Committee
<br />is awaiting a copy of the draft which will be submitted to the Legislature. 2.
<br />Copies of all legislative matters will be sent to the entire Boa.rd hereafter, rather
<br />than to just the members of the Legislative Committee. 3. Mr. Sparks is re-
<br />questing the Southeastern Colorado Water Conservancy District to support a re-
<br />quest that the 46th General Assembly withhold action on any water-related legis-
<br />lation until the Colorado Water Conservation Board can propose a coordinated
<br />program.

<br />After genera} discussion, Mr. Dilley moved, seconded by Wagner, that the Board
<br />adopt a Resolution stating that the Board will withhold support for any water-re-
<br />lated legislation, until the Colorado Water Conservation Board submits its pro-
<br />posed coordinated legislation, and the Board has had an opportunity to study it.
<br />Also, that we will request our legislators not to act on any water-related legisla-
<br />tion until the Colorado Water Conservation Board proposal is received by the
<br />Legislature. Motion unanimously carried.
