<br />.No charge shall ever be imposed for water released from, or made <br /> <br />available by reason of releases from, the replace'rrent capacity of the <br /> <br />Aspen Reservoir. <br /> <br />7. That portion of the total capacity of the Aspen Reservoir not" <br /> <br />needed as replacement capacity constitutes surplus capacity. Water stored <br /> <br />in such surplus capacity may be sold or leased by the United States to <br /> <br />water users in Western Colorado. Charges for the use of such water shall <br /> <br />be cOl'.1parable to charges for use of project water for similar purposes <br /> <br />in Eastern Colorado vdth appropriate adjustment for the repayment ability <br /> <br />of such water users. If it hereafter appears that the cost of procuring <br /> <br />water, frpm sources other than the surplus capacity of the Aspen Reser- <br /> <br />voir, for the same uses as those to which water from the surplus capacity <br /> <br />of the reservoir is to be made available shall have been increased by <br /> <br />reason of the construction and operation of the project, then the charges <br /> <br />for water released from the surplus capacity shall be diminished by the <br /> <br />amount of such incrllase in cost. <br /> <br />8, Project diversions from Lime Creek shall be made only in the <br /> <br />months Of May and June of each year. <br /> <br />9.
