Using the evaluations in the EA and the <br /> <br /> <br />public comments, 'the Bureau identified a Preferred Alternative. The Record of <br /> <br />Decision for the DreferredAlternative is presented in Appendix H. <br /> <br /> <br />The next step in the process was to prepare a Supplement to the FES on <br /> <br />the Fryingpan-Arkansas project. However, since the EA of all alternatives had <br /> <br /> <br />previously been dtstributed to the public, the Supplement will not repeat the <br /> <br />analyses of all alternatives, but will evaluate the No Action alternative <br /> <br /> <br />(which represents current conditions) and the Preferred Alternative. The EA <br /> <br />is incorporated into this Supplement by referepce. <br /> <br />. <br /> <br />1.3 Authorization for Project <br /> <br /> <br />Ruedi Reservoir was constructed as an integral part of the Frytngpan- <br /> <br />Arkansas Project authorized by Congress in P.L. 87_5900 in August, 1962. That <br /> <br /> <br />legislation was in accordance with House Document No. 187, 83rd Congress; <br /> <br /> <br />modified by House Document No. 353, 86th Cong~ess; and the Fry-Ark Project <br /> <br /> <br />Operating Principles in House Document No. 1030" 87th Congress. The body of <br /> <br />legislation required compensatory storage on the western slope as a prere- <br /> <br /> <br />quisite to the diversion of water from the Colorado River basin by an eastern <br /> <br /> <br />slope water conservancy district. <br /> <br /> <br />The Operating Principles state; (paragraflh 3) "The receipts from the sale <br /> <br />of water from Ruedi Reservoir. , . shall be ~pplied soiely to the'operation <br /> <br /> <br />and maintenance costs and to those reimb~rsea~le construction costs of"said. <br /> <br /> <br />reservoir which exceed $7,600,000. The cost df perpetual operatio~ and main- <br /> <br /> <br />tenance of the Ruedi Reservoir shall be borne by users of project water and <br /> <br />users of water stored in Ruedi Reservoir in such proportion as' maY be deter~ <br /> <br /> <br />mined by the Secretary :'of the Interior." <br /> <br /> <br />Paragraph 6(b) of the Operating principl~s states; <br /> <br />"The regulatory capacity of Ruedi R~servoir . . . is that por- <br />tion of the total reservoir capacity notineeded, for replacement pur- <br />poses. Water stored in such cat~gory ma~ be sold or leased by the <br />United States to water users in Colorado for any purpose recognized <br />by the laws of the United States: Provided that the sale of water <br />for use outside the natural basin of the Colorado River can only be <br />made with the consent of the Colorado River water Conservation <br />District. Charges for the use of such water shall be established by <br />the Secretary of the Interior by appropriate contract in accordance <br />with the payment ability of such water uf'ers." <br /> <br />, <br />
