This Consultation Plan addresses consultation with tribes in <br />three distinct but sometimes overlapping contexts: (I) the Glen Canyon Dam Adaptive <br />Management Program (AMP), specifically the Adaptive Management Work Group, a <br />federal advisory committee; (2) the Programmatic Agreement on Cultural Resources <br />regarding the Operations of Glen Canyon Dam (PA) and the Historic Preservation Plan; <br />and (3) government-to-government consultation between federal agencies and Indian <br />tribal governments. <br /> <br />[NOTE: The SPAHG report calls for distinguishing between two types of consultation: <br />that "between the Secretary of the Interior and the AMP as mandated in the Grand Canyon <br />Protection Act. and consultation between federal agencies and Tribes." The SP AHG <br />report also calls for making changes in the Draft so that: <br /> <br />"Sections that apply to the AMP and the sections that apply to the Historic <br />Preservation Plan are clearly delineated and distinguished," <br /> <br />"AMP relationships and the Programmatic Agreement relationships are <br />distinguished." <br /> <br />As consultation within the context of the AMP must be distinguished from government-to- <br />government consultation, so consultation in the context of historic preservation also must <br />be distinguished from government-to-government consultation. In both cases, sufficient <br />attention by federal agencies to the concerns of tribes may reduce or avoid the need for <br />government-to-government consultation. On the other hand, in both cases, issues may <br />arise that tribal or federal representatives regard as giving rise to a need for government- <br />to-government consultation, Accordingly, this Draft recognizes that consultation <br />involving tribes and federal agencies may occur in three distinct contexts,] <br /> <br />While the focus of this Consultation Plan is relations between federal and tribal <br />representatives, it may also be useful in guiding relations among the state and non- <br />governmental representatives in the AMP and the tribal representatives. <br /> <br />(1) Consultation witbin tbe Adaptive Management Program <br /> <br />The Glen Canyon AMP has been established to guide the implementation of the <br />Record of Decision (ROD) on the Final Environmental Impact Statement (FEIS) on the <br />Operation of Glen Canyon Dam, in accordance with the Grand Canyon Protection Act. <br />The Adaptive Management Work Group (AMWG) is a federal advisory committee, <br />established pursuant to the Federal Advisory Cornmittee Act (FACA), 5 V.S.C. App. 2 <br />that operates according to a charter issued by the Secretary. The AMWG includes <br />representatives from concerned federal agencies, state agencies, tribes and non- <br />governmental organizations. Members of the AMWG are appointed by the Secretary; <br />representatives of the Hopi Tribe, Hualapai Tribe, Navajo Nation, Zuni Indian Tribe and <br />Southern Paiute Consortium serve as members of the AMWG. As a federal advisory <br />committee, the AMWG provides recommendations to the Secretary of the Interior's <br />Designee, who is the federal official that chairs the AMWG and forwards the AMWG's <br /> <br />3 <br />
