<br />00529 <br /> <br />REVISED DRAFT (#IO)-August 11.2004 <br />Clean Version <br /> <br />Act (NEP A) requires consultation under these Protocols, whether the level of <br />documentation is an EIS or an EA. The extent to which consultation will be <br />required for actions treated as categorical exclusions will be subject to discussions <br />in meetings pursuant to Sections A and B of this Part. <br /> <br />(b) A federal project, activity, or program that is not specifically addressed in the <br />HPP may be considered an undertaking meeting the definition at 36 CFR <br />800.16(y) - unless determined by the federal agency not to be an "undertaking" <br />pursuant to Part 5. <br /> <br />(c) Actions taken as part of program for monitoring or restoration of endangered <br />species require consultation under these Protocols, unless through consultation <br />under Sections A and B of this Part, a decision has been reached that consultation <br />is unnecessary for the specific action or category of actions. <br /> <br />(d) Any other action that is funded, approved, or promoted by the AMP is <br />considered to be a federal action (because any such action must be either <br />approved, licensed. pennitted or funded by a federal agency, e.g., BOR, GCMRC, <br />NPS). This specifically includes research, monitoring and management actions <br />carried out by GCMRC or funded by GCMRC. <br /> <br />(e) Any AMP-funded river trip. <br /> <br />(2) Consultation for Proposed Actions Subject to NEPA <br />Documentation <br /> <br />[NOTE: This was moved from Part 9 of the previous Draft. and revised a little, both to <br />make it fit here and in response to comments.] <br /> <br />For any proposed federal action for which the responsible federal agency <br />detennines that a NEP A document will be prepared, whether the document is an EIS or <br />an EA, the agency shall provide notice to each of the Tribes at least as early as the <br />"purpose and need" phase of the preparation of the NEP A document. Upon request of a <br />Tribe, the agency will consult with the Tribe regarding their concerns and possible <br />involvement in the preparation and/or review of the NEPA document. This includes <br />actions taken for the protection and recovery of species listed under the Endangered <br />Species Act (ESA) when such actions require NEPA documents. <br /> <br />(3) Consultation pursuant to the Historic Preservation Plan <br /> <br />When a proposed action is also an undertaking subject to the National Historic <br />Preservation Act (NHP A) with the potential to affect historic properties or other cultural <br />resources, the proposal will be brought to the attention of the signatories to the <br /> <br />20 <br />
