The donated water right is not currently decreed for instream flow use by the <br />CWeB. The SEO has required that donated rights be decreed specifically for instream <br />flow use, and has argued that a "fishery" use is not the same as "instream flow use by the <br />CWCB". Staff has concurred with this position. <br />. Is this currently an absolute water right? The CWCB cannot accept conditional water <br />rights. Has Pueblo perfected the RICO use at night? If not, what would they be <br />conveying to CWCB? If they can perfect the nighttime RICO right, why do they need to <br />convey it to the Board? <br />
