Insofar 99 we know <br />this represents the first time your Company ,has had 9uch protec.. <br />tion. <br /> <br />Durinll recent yeaTS the public in general has become more and <br />more law.suit conscience when any.damage is sustained by them, be <br />it either to their person or property. And of course in an opera~ <br />tion such as that of the Amity, there is inherent certain rlsks <br />to the persons and property of the public, and even the possibil- <br />ity of damage elther by acts of omission or commission by employ- <br />ees of the Amity. <br /> <br />With these things in mind, and weighing possible consequences <br />against the known cost of insurance, your directors purchased the <br />liability insurance and your Attorneys both urged and recommended <br />this act ion. <br /> <br />The report of the Superintendent discusses briefly the con- <br />troversy concerning the passing of 100 c.f.s. through John Martin <br />Dam after Novelllber 1, as per the Arkansas River Compact. Ameeting <br />on thiS matter was held with the State Engineer in Denver in Jah- <br />uary, 1963 at which were present several representatives from the <br />Amity, Including your Attorney, as well as representatives from <br />other ditches. <br /> <br />It is felt this matter can best be covered by diSCUSSion at <br />the annual meeting rather than by a written report. <br /> <br />May we In closing extend our appreciation to the Superinten~ <br />dent, officers, Directors and individual stockholders for their <br />cooperation during the year past. <br /> <br />Respect fully submitted, <br /> <br />ALLOTT AND ROGERS, Attorneys <br /> <br />-7- <br />
