<br />1 (II) THE PERCENTAGE LEVEL OF THE FEDERAL POVERTY LINE,
<br />2 AS DEFINED PURSU~NT TO 42 U.S.C. SEC. 9902 (2), USED TO
<br />3 DETERMINE ELIGIBILITY UNDER THIS PARAGRAPH (c) SHALL BE ONE
<br />4 HUNDRED PERCENT. IF THE FEDERAL GOVERNMENT ESTABLISHES A NEW
<br />5 FEDERAL MINIMUM PERCENTAGE LEVEL OF THE FEDERAL POVERTY LINE
<br />6 USED TO DETERMINE ELIGIBILITY UNDER THIS PARAGRAPH (c) THAT IS
<br />7 DIFFERENT FROM THE LEVEL SET IN THIS SUBPARAGRAPH (II), THE
<br />8 STATE DEPARTMENT IS AUTHORIZED TO MEET SUCH FEDERAL MINIMUM
<br />9 LEVEL WITHOUT REQUIRING ADDITIONAL LEGISLATION; HOWEVER, SUCH
<br />10 MINIMUM FEDERAL LEVEL SHALL BE ESTABLISHED BY RULE AND
<br />11 REGULATION BY THE STATE BOARD OF SOCIAL SERVICES.

<br />14 Repl. Vol., as amended by Senate Bill 91-105, enacted at the
<br />15 First Regular Session of the Fifty-eighth General Assembly, is
<br />16 amended to read:

<br />18 26-4-520. Hospice care. (1) The medical assistance
<br />19 program in this state shall include hospice care. EXCEPT AS
<br />20 OTHERWISE PROVIDED IN SUBSECTION (2) OF THIS SECTION, 'hospice
<br />21 care shall be provided for a period of up to two hundred ten
<br />22 days in accordance with rules and regulations adopted by the
<br />23 state board, which rules and regulations shall comply with
<br />24 section 1905 of the social security act, 42 U.S.C. sec. 1396d,
<br />25 and shall include at least the following requirements:

<br />27 (a) That a person shall obtain a certified medical
<br />28 prognosis indicating a life expectancy of six months or less,
<br />29 which certification shall comply with rules and regulations
<br />30 adopted by the state board;

<br />32 (b) That a person shall execute a waiver of other
<br />33 medical benefits available under this article, which election
<br />34 sha 11 be executed in. accordance with rul es and regul at ions
<br />35 adopted by the state board;

<br />37 (c) That the service shall be reasonable and necessary
<br />38 for the palliation or management of the terminal illness and
<br />39 related conditions.

<br />4I (2) HOSPICE CARE MAY BE PROVIDED TD A PERSON BEYOND TWO
<br />42 HUNDRED TEN DAYS IF SUCH PERSON IS RECERTIFIED BY A PHYSICIAN
<br />43 OR HOSPICE MEDICAL DIRECTOR AS TERMINALLY ILL IN ACCORDANCE
<br />44 WITH SUBSECTION (1) OF THIS SECTION.".
