Yampa River Instream Flow Appropriation <br /> <br />The following is one of several options which have been developed through extensive <br />consultations over the last year among representatives of the Colorado Water Conservation Board <br />(CWCB), State Engineer and Division Engineers, Attorney General, Colorado River Water <br />Conservation District, Colorado Water Congress, U.S. Fish and Wildlife Service, and many other <br />water interests for consideration by the CWCB in late 1995 as a part of its efforts to appropriate <br />endangered fish recovery instream flows in the Yampa River. <br /> <br />Concept <br /> <br />An instream flow right based on the FWS flow recommendation minus a development <br />allowance is appropriated. A Base Flow component is included in the instream flow right <br />during the non runoff months at the 80% exceedance level. The following Table lists the <br />appropriation amounts: <br /> <br />Runoff Monlhs: <br />Non Runoff Months: <br />Base Flow: <br /> <br />10% Exceedance flow minus the monthly development allowance. <br />20 % Exceedance flow minus the monthly development allowance. <br />80% Exceedance flow <br /> <br />A development allowance ranging from 52,000 af to 225,000 af is provided to allow <br />development of Colorado's unused compact apportionment The development allowance <br />consists of a Carve Out and a Modifiable Portion (Paragraph 4). <br /> <br />Monthly instream flow call triggers are developed for each month; when the flow at the <br />Maybell gage drops below the monthly instream flow call trigger, junior water right are called <br />out to meet the instream flow appropriation. <br /> <br />The Carve Out, distributed on a monthly basis, is remains available for use by both senior <br />conditional rights and water rights junior to the instream appropriation and is not included in <br />the appropriation.
