<br />n f ':.. () ':)... <br />'.J' .~ [ ...; ':J ~ <br /> <br />"The Local Government Land Use Control Enabling Act of 1974" (HB 1034) lias also enacted on <br />May 17,1974. This statute grants to local government "....authority to plan for and regulate <br />the use of land by: regulating development and activities in hazardous areas; protecting lands <br />from activities which would cause...danger to significant wildlife habitat and...endanger a <br />wildlife species; preserving areas of historical and archaeological importance; ...regulating <br />the location of activities and developments which may result in significant changes in population <br />densitYi ...regulating the use of land on the basis of the impact thereof on the corrmunity or <br />surroundi ng a rea 5; . . . " Th i slaw provi des broad a uthori ty to 1 oca 1 government to plan for and <br />regulate the land use of land and protection of the environment in a manner consistent with <br />constitutional rights. <br /> <br />This Act also encourages local government to cooperate with other units of government for the <br />purpose of planning or regulating the development of land. <br /> <br />Title 30, Article 28. Section 133 CRS 1973 (SB-35) requires counties to develop subdivision <br />regulations which require the subdivider to provide information on water quality and quantity, <br />sewage disposal, and geological and soils conditions. <br /> <br />Under terms of Title 29, Article 21, CRS 1973 (HB-l084) enacted in 1974, the Colorado Assembly <br />created a conservation forest fund in the office of the State treasury. Under its terms, coun- <br />ties or municipalities which have established a conservation forest fund will be entitled to <br />State funds to be used for acquiring, developing, and maintaining lands which are to be used <br />for all types of open space. <br /> <br />The USDA Forest Service, Colorado State Forest Service, and Gunnison County in 1974 entered <br />into a cooperative land use planning aqreement which provides for coordination of activities <br />on forest and related lands within the county and for the participating parties to provide <br />advice and share expertise on land use matters. <br /> <br />n <br />
