<br />RESOLUTION OF THE COLORADO WATER CONSERVATION BOARD <br />REGARDING DELIVERY OF WATER FROM WOLFORD MOUNTAIN RESERVOm <br /> <br />March 11, 1998 <br /> <br />CONCERNING THE DELIVERY OF WATER TO THE 15 MILE REACH OF THE COLORADO RIVER TO <br />PROTECT THE ENDANGERED FISHES OF THE UPPER COLORADO RIVER BASIN. <br /> <br />WHEREAS the Colorado Water Conservation Board (Board) hereby determines that the loan of <br />Wolford Mountain Reservoir water from the Colorado River Water Conservation District (District) to <br />the Board for delivery to and through the 15 Mile Reach of the Colorado River in accordance with the <br />attached Memorandum of Agreement (MOA) is an element of the Recovery Implementation Program <br />Recovery Action Plan (RIPRAP) required to preserve the natural environment to a reasonable degree <br />for the benefit of the listed species in the Upper Colorado River basin. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE Colorado Water Conservation Board that: <br /> <br />(1) The loan of water pursuant to the MOA is required for minimum stream flows to <br />preserve the natural environment to a reasonable degree. This 6,000 af along with <br />other water and/or water rights is presently needed to preserve the natural environment <br />to a reasonable degree, as the Board has or may in the future determine. <br />(2) The purpose of the loan is to benefit the listed species in the Upper Colorado River <br />basin. <br />(3) Paragraph 3 of the Memorandum of Agreement entered into on September 21, 1993, <br />between the Board and the U.S. Fish and Wildlife Service (the Enforcement <br />Agreement), a copy of which is attached as Exhibit I will apply to the loan. <br />(4) The Board has the authority to enter into the MOA. <br />(5) The Board hereby authorizes the Director to execute the MOA. <br /> <br />BE IT FURTHER RESOLVED that copies of this Resolution be sent to: the Colorado River <br />Water Conservation District and the U.S. Fish and Wildlife Service. <br /> <br />CERTIFICATE <br /> <br />We certify that the foregoing is a true and correct copy of a resolution duly considered and <br />adopted by the Colorado Water Conservation Board at their regular March, 1998 meeting to reaffirm <br />the November 21,1994 Resolution adopted by the Board regarding the delivery of water from Wolford <br />Mountain Reservoir. <br /> <br />Y.vkv ~.~ <br /> <br />Peter H.
