<br />Court to Hear <br />Bid to/ Block <br />Foothills Suit <br /> <br />By GEORGe LANE <br />Denver Post Staff Writer <br />Chief U.S. District Judge Fred Winner <br />has set Sept. 8 for a hearing in Denver on <br />a request by the Denver Water Board for <br />a temporary restraining order to biock a <br />suit filed against the F09thills water 'proj- <br />ect several weekS ago in Washington. <br />The Washington suit seeking to block <br />the controversial, $135 million project was <br />filed on behalf of six environmental <br />gronps against lnterior Secretary Cecil <br />Andrus, Agriculture Sectetary Bob Burg- <br />Innd, Secretary, of the Army Clifford <br />Alexander and Douglas Costle, director of <br />the U,S. Environmental Protection <br />Agency. , <br />Before the suit was filed in Washington, <br />the Denver Water Board had filed suit in <br />Denver federal court seeking $36 million <br />in damages and a court order preventing <br />any future federal or private interference - <br />inthe construction of Foothills. ' <br />JOINING THE WATER board as ']llain- <br />tiffs in the suit were the Homebuilders <br />Association of Metropolitan Denver, the <br />Lnkl\rllod Water and Sewer Commission <br />and=r:('metmpoiitan Denver water and <br />sewe.r~slricts. ' <br />Deliiidants in the water board action <br />are liUederal officials in the U,S. Envi. <br />ronmWital Protection Agency, the U,S~ In~ <br />teriot;Agriculture and the Army depart- <br />ment!;' and 14 environmental groups. <br />Aftt!- the water"board suit was filed <br />,and belOre,the suit was filed by the envi. <br />ronmental groups, Winner invited all in. <br />terested parties to join the' Denver-based' <br />suit.
