Are waters used from the Lower Basin <br />tributaries included in the calculation <br />of allowable beneficial consumptive uses <br />apportioned to the Lower Basin by Article <br />III(a) and (b). <br />2. If they are, then what contribution to the <br />Mexican Treaty obligation is imposed by <br />Article III(c) on the Lower Basin when <br />(a) beneficial consumptive uses in the <br />Lower Basin exceed 8.5 m.a.f., <br />(b) the supply in the Lower Basin (by <br />including its tributaries) substan- <br />tially exceeds 8.5 m.a.f., and <br />(c) the actual demand for water in the <br />Upper Basin exceeds that available <br />after delivery of 75 m.a.f. in <br />successive ten year periods at Lee's <br />Ferry. <br />3. Must there be more water used in the <br />entire Colorado River system than the 16 <br />m.a.f. apportioned by Article III (a) and <br />(b) before the Upper Basin can invoke <br />curtailment of Lower Basin uses in excess <br /> <br />-14- <br />
