<br />Western 'Colorado in lieu of that reservoir for the purpose of <br /> <br /> <br />"L 1 ;~~tecting water uses in Western Colorado. <br /> <br />(r) "c.f.s." means cubic feet of water per second of time. <br /> <br />2. The Aspen Reservoir shall be constructed and maintained on the <br /> <br />Roaring Fork River above the town of Aspen, Colorado, with an active capacit~' <br /> <br />of about 28,000 acre-feet and ,vith a reasonable expectancy that it will fill <br /> <br />annually. The 2C,OOO acre-feet of v/ater stored therein sha:.l to available <br /> <br />for replacement purposes in Western Colorado. All of such stored water <br /> <br />shall be released under the conditions and limitations hereinafter set <br /> <br />forth. <br /> <br />3. The cost of c,mstru~ti0n and perpetual operation and Maintenance <br /> <br />of the Aspen Reservoir shell be a charge against the prC1je:ct and shall be <br /> <br />paid from project revenues or as othernise provider: by the ConGress of the <br /> <br />United States. <br /> <br />4. The Aspen Reservoir shall be Gompleted oefore any water is <br /> <br />diverted to Eastern Colorado by means of the project. <br /> <br />S. The prL~ary purpose of Aspen Reservoir is to fv~nish the water <br /> <br />required for the protection of Hestern Colorado water users in accordance <br /> <br />-with-provisions-of-Section-l,-Chapter-19l,-C510raao-SesSion-La::s,-r943; <br /> <br />6. The replacement capacity of the Aspen Heservoir is that portion <br /> <br />of the total reservoir caracity required to protect existinG riGhts to the <br /> <br />use Of v/ater in "'estern Colorac'o ~or domestic, irri(;ation, and ';Janufacturing <br /> <br />purposes (including p01"er generation) and hereafter acquired rights to the <br /> <br />use of water in Weste~'" G,,1.or~do for domestic, irri:;ation, and manufacturing <br /> <br />purposes (excluding rOHer' ,;erieration) against any nnc'. all losses of needed <br /> <br />water because of stre&l1l depletions resulting from project operations.
