<br />0010 <br /> <br />, ' <br />. I ~, <br /> <br />". (1) terms and conditions which will (i) carry <br />out the purposes of applicable statutes and rules and <br />regulations issued thereunder; (ii) minimize damage to <br />scenic and esthetic values and fish and wildlife <br />habitat and otherwise protect the environment; (iii) <br />require compliance with applicable air and water <br />quality standards established by or pursuant to applic- <br />able Federal or State law; and (iv) require compliance <br />with State standards for public health and safety, <br />environmental protection, and siting, construction, <br />operation, and maintenance if those standards are more <br />stringent than applicable Federal standards; and <br /> <br />(2) such terms and conditions as the authorized officer <br />deems necessary to (i) protect Federal property and <br />economic interests; (ii) manage efficiently the lands <br />which are subject to the use or adjacent thereto; (iii) <br />protect other lawful users of the lands adjacent to or <br />occupied by such use; (iv) protect lives and property; <br />(v) protect the interests of indivduals living in the <br />general area of the use who rely on the fish, wildlife, <br />and other biotic resources of the area for subsistence <br />purposes; (vi) require siting to cause the least damage <br />to the environment, taking into consideration feasi- <br />bility and other relevant factors; and (vii) otherwise <br />protect the public interest." <br /> <br />The terms and conditions of this easement (Exhibit 4) were <br />developed through the NEPA process by refining and adding to <br />the initial environmental protection plan submitted by the <br />Cities in their application. The DE IS included mitigation <br />measures for each action alternative and a grant document <br />for the readers to review. The terms and conditions required <br />by FLPMA and imposed in this easement are cross-referenced <br />to the mitigation measures in the FEIS in Exhibit 5. Exhibit <br />5 also includes citations to the provisions of Section 505 <br />of FLPMA upon which the conditions or stipulations in the <br />easement are based. The request of the Cities to use the <br />National Forest land without the, conditions and stipulations <br />of the easement would violate FLPMA and the request would be <br />denied. The compliance with Section 505 of FLPMA satisfies <br />the requirements of NEPA (40 CFR 1505.2[c]). This decision <br />includes all practicable means to avoid or minimize environ- <br />mental harm. <br /> <br />6. The area necessary for occupancy during and after construc- <br />tion will be as shown on the Final Construction Plans <br />approved by the Forest Supervisor. This area will be <br />limited to the specific ground necessary for operation and <br />administration of the project. The grant document provides <br />for operation and maintenance, along with public safety. In <br />addition, the grant provides mitigation measures on National <br />Forest System lands to assure that there will be no unneces- <br /> <br />9 <br />
