<br />0021 <br /> <br />" .,! <br /> <br />The practical effect of the Williams Fork Deci$ion is to reinstitute the <br />procedures used before FLPMA. Therefore, an application to amend the <br />right-of-way would be filed and processed under pre-FlPMA regulations which <br />would be the 1979 Code of Federal Regulations. A copy of these regulations <br />which provide all the steps that need to be taken in fi1 ing an appl.ication lS <br />enclosed. <br /> <br />Once an application is filed, it will be referred to the Forest Service for <br />their report as to whether the amendment should be allowed and recommendations <br />for any stipulations or bonding that agency deems necessary. The Forest <br />Service will prepare any environmental and land use planning documents <br />necessary to analyze the proposed action and make a decision. We will adopt <br />the Environmental Statement prepared by the Forest Service for the Homestake <br />II Project if the statement meets BLM standards for environmental <br />documentation. Our actions will be closely co~rdinated with those of the <br />Forest Service. It is possible that BLM and the Forest Service will enter <br />into an Memorandum of Understanding which will, set out each agency's <br />responsibilities with regard to these kinds of rights-of-way.
