IOn January 4, 1983, John Brink of <br />EPA telephoned the Forest Service with final suggested changes. <br /> <br />In addition to the comments that were received during the public comment <br />period and published in Section 6.2 of the final EIS, we have considered <br />other comments that were received up to t~e time of printing the FEIS. <br />These comments are paraphrased and refere~ced to relevant Sections of the <br />FEIS (Exhibit 7). ! <br />I <br />I <br /> <br />VIII. IMPLEMENTATION <br /> <br />In order to comply with FSH 1909.15, Section 37.2 (46 FR 57012), ground <br />disturbing activities will not be allowed sooner than 30 days from the date <br />of publication of the Notice of Availability of the FEIS in the Federal <br />Register by EPA. In addition, the following are required: 1) construction <br />plans must be approved by the Forest Service as required by the Easement; <br />2) all Federal, State, and local requirem~nts for permitting must be met <br />before construction begins; 3) prior to initiation of construction, the <br />Cities must obtain State Water Court approval for changes in points of <br />diversion in accordance with the selected alternative; and 4) the Cities <br />must implement the Phase I streamflow adjustments and have the Phase I <br />improvements in place or initiated, as described in the FEIS, Section <br />4.1.17, pages 4-54 through 4-58 and Exhibjt 4, Easement Condition No. 22, <br />attached. ' <br /> <br />IX. RIGHT TO ADMINISTRATIVE REVIEW <br /> <br />This decision is subject to appeal pursuant to 36 CFR 211.18 (Federal <br />Register, Vol. 48, No. 63, March 31, 1983, pages 13420 to 13426). Notice <br />of appeal must be in writing and submitted to me at 11177 West 8th Avenue, <br />Lakewood, Colorado 80225 within 45 days from the date of this decision.
