Reclamation personnel are available to the Tribe to conduct a tour of the areas of <br />potential effect, to discuss inventory and evaluation methods under the present Memorandum of <br />Agreement, and to confer on any mitigation measures should they become necessary during the <br />Carriage Contract project. The tribe will be invited to be a consulting party if a new <br />Memorandum of Agreement is negotiated. <br /> <br />Comment 42- The State Historic Preservation Officer expressed concern for the protection of <br />cultural resources and made recommendations concerning these resources. <br />Response 42- The Carriage Contract project plan has incorporated cultural resource protection <br />commitments as discussed in the Cultural Resource section of the final EA. <br /> <br />Indian Trust Assets <br /> <br />Comment 43-eoncerns were expressed that the Carriage Contract could adversely affect Indian <br />Trust Assets by reducing irrigation return flows to the San Juan River. This in turn could require <br />increased releases from Navajo Reservoir on the San Juan River to meet endangered fish flow <br />recommendations-thus leaving less water in Navajo Reservoir to meet other water needs, <br />including the water rights of Indian Nations or Tribes. <br />Response 43-The proposed action would add as much water to the San Juan River as any other <br />alternative and would add more water than some of the possibilities under the "No Action" <br />altemative. Thus, as explained in the final EA, the proposed action should not adversely affect <br />the ability to meet the San Juan River flow recommendations nor would it reduce flows in <br />endangered fish critical habitat.
