Under the Endangered Species Act: <br /> <br />-Property rights and water rights must be recognized <br />and protected; <br />-Property owners must be fairly treated; <br />-Social and economic impacts must be minimized; <br />-Sound science must be used in listing of species and <br />designa'jon of critical habitat; and, <br />-There must be incentives to conserve rare and unique <br />species. <br /> <br />Position Statement <br />Endangered Species Act <br />(Resolution 97-1) <br /> <br />The Endangered Species Act shall be implemented. <br />reformed and reauthorized subject to the following: <br /> <br />I. Water: <br /> <br />a. No Federal Water Law: The Act does not, and shall <br />not, create federal water law or federal rights in <br />water. <br /> <br />The Act shall not be construed or used, to impair, <br />abrogate, supersede or amend: <br /> <br />(1) vested water rights granted by the respective <br />states for beneficial uses; <br />
