080653

Enlargement MOA-We have received signed MOAs from the following
entities:

Entity
CS-U
City of Fountain
Pueblo West
Board of Water Works of Pueblo
Otero County
City of Florence
Crowley County
Town of Poncha Springs
City of Salida
Upper Arkansas Water Dist.
EWMS (15%)
EWMS Additional
Total
*pending final approval

Acre-feet Requested
30,000
10,000*
5,500*
5,000
5,000
1,000
1,000
125
500
500
8,794
1 ,206*
68,625 acre-feet

It is my recommendation that the Board approve the Enlargement MOAs, that
have been submitted to date, allow additional time for Pueblo West and the City
of Fountain, and that the Enterprise participate by requesting 1,206 acre-feet in
additional enlarged storage capacity. The 1,206 acre-feet would provide the
Enterprise with a total of 10,000 acre-feet of storage to meet the purposes
described in the PSOP Implementation Committee Report, including water
banking. The 1,206 acre-feet will cost the District $45,300 in implementation costs
(over 4 years) and $2.4 million in construction costs (in the year 2011). With the
PSOP Implementation Fund ($1 million) already in place and the designation of
$2 million for enlargement participation in the proposed District Budget, we should
be able to fund our involvement without changes in our existing mill levy.

An additional idea: the Enterprise could also include an additional 6,375 acre-feet
to take the total requests up to the 75,000 acre-feet limit. The funding of this extra
amount becomes tricky.

PSOP Implementation Legislation- I've sent the attached letter to
members of Colorado's congressional delegation updating them on our
agreement with Aurora and progress on other outstanding issues related to the
District's Preferred Storage Options Plan (PSOP). I also called Congressman
Tancredo's office and spoke directly with his legislative director so that they would
know firsthand that the District and Aurora have reached an agreement.

3

~ c.;
